I read an article today that really hit home. I have practiced Social Security disability law for over 27 years. During that time, I have NEVER witnessed the long delays in the system that I am seeing now. The article noted that data obtained by The Washington Post paints a grim picture of the holdups claimants are confronting across the country. In Texas, it took 214 days on average in fiscal 2022 to process an initial application. Wisconsin took 227 days, up from 90 days in fiscal 2019. Florida’s average time has almost tripled to 225 days. Georgia is taking 246 days. And Delaware now holds the record for the longest wait: 261 days. The pileup of cases has driven a normally three-month wait for an initial review to at least seven, the data shows. But in states struggling most to catch up, it’s taking well over a year. That is over a YEAR (and I have seen my own clients wait a year and a half lately) for the FIRST decision. During that time, people are without income and many are without medical coverage that they so desperately need to treat the ailments that have led them to file for disability in the first place. Even after the first denial (and about 2 in 3 people are denied initially) they have to endure yet another year long wait, before they get to wait AGAIN for a hearing before an Administrative Law Judge if they are denied. This is not acceptable. While many may think this could not affect them, I can tell you many are a day away, a car accident away, a cancer diagnosis away, a work accident away, a back injury away, etc. from being in these same shoes. This must change and the only way we can hope for real change is if people start contacting their congress person and raising the roof.

The good news is here! The benefits for Social Security beneficiaries will increase 8.7 percent in 2023. Additional good news is that Medicare premiums will not increase in 2023. This increase will help so many disabled and retired beneficiaries handle the cost of living that we have all experienced.

Social Security beneficiaries are normally notified by mail starting in early December about their new benefit amount. The fastest way to find out the new benefit amount is to access your personal "my Social Security" account to view the COLA notice online. It’s secure, easy, and you can find out before the mail arrives. You may also opt to receive a text or email alert when there is a new message from Social Security--such as their COLA notice--, rather than receiving a letter in the mail. You may create or access your "my Social Security" account online at www.ssa.gov/myaccount.

A little bit of good news for those that are drawing Social Security Retirement Benefits or Social Security Disability Benefits. The Social Security Administration is getting ready to announce the cost-of-living adjustment (COLA) for Social Security beneficiaries in 2023, and it’s expected to be a sizable increase. Based on recent CPI-W data, the COLA adjustment for 2023 is expected to be one of the largest in decades: the nonprofit Senior Citizen’s League most recently projected an 8.7% increase in benefits based on the latest CPI-W. Beneficiaries can expect an official announcement on 2023’s COLA increase in mid-October (around the 13th) according to the Senior Citizen’s League. The projected 2023’s COLA increase is significantly higher than 2022’s (5.9%) and the biggest since 1981, when beneficiaries received an 11.2% adjustment. Some years, however, the COLA was 0%. Despite an announcement later this month, the increased benefits wouldn’t take effect for the country’s roughly 66 million Social Security beneficiaries until January 2023.
The Social Security Administration had recently estimated that Social Security benefits make up a collective 30% of the income of elderly Americans. It’s a sizable chunk, though the Senior Citizen’s League worries that 2023’s projected COLA increase, at an estimated 8.7%, is still not enough to address most seniors’ needs. I will post again as soon as the official announcement is made of the increase amount.
