Washington has enacted new employer obligations related to federal immigration inspections, with the law generally effective June 11, 2026, and notice/enforcement provisions effective October 1, 2026. Employers must provide written notice to workers and their representatives within five business days of receiving an inspection notice and again within five business days of receiving results identifying potential work authorization issues.

The state will issue required posters and model notices by September 1, 2026, and employers must also understand limits on granting access to non-public areas or records without proper legal authority.

Employers may want to review separation templates to ensure provisions do not interfere with employees’ Section 7 rights. Read the full analysis and recent decision context:

OSHA has extended its heat‑related National Emphasis Program, increasing inspection activity on heat priority days as temperatures rise.

Employers in high‑risk industries should revisit acclimatization, hydration, and training protocols, particularly for new or returning workers. Seasonal preparation can help support worker safety and inspection readiness.
