On June 9, 2025, after the New York state Assembly approved the bill....Gov. Kathy Hochul signed an amended version in February; it is scheduled to take effect Aug. 5.

A similar law is slated to take effect in September in Illinois, which would become the 13th state (plus the District of Columbia) where medical aid in dying is legal.

“A breakthrough moment,” said Kevin Díaz, president of Compassion & Choices, which has spearheaded the long campaign for such laws.

After almost 30 years — Oregon’s law, the first in the country, was enacted in 1997 — the addition of two populous states means that almost a third of Americans will live in one where medical aid in dying is legally available.

Argentum Vice President of Government Relations Paul Williams told McKnight’s Senior Living that Section 1115 Medicaid demonstration programs — and related HCBS authorities — play a critical role in enabling states to deliver care to older adults who meet a skilled nursing facility level of care, but whose needs can be safely and appropriately met in assisted living communities.

New federal guidance aimed at placing tighter budget neutrality requirements on Medicaid Section 1115 waiver programs is being called a “constructive step” toward strengthening the program's sustainability by the senior living industry.

There are many variables to consider; at 2-3 hours per day, 60-90 hours per month, assisted living can be less expensive.

Assisted living provides support for all activities of daily living, 3 meals daily, medication management, activity and socialization along with many other amenities that can improve the quality of life for an older loved one.

When someone develops cognitive impairment or dementia, their ability to recognize risks and make safe decisions often declines over time. Waiting until after a fall, hospitalization, or other crisis to discuss a move can make the conversation far more challenging. Exploring options early allows families to plan thoughtfully and gives the individual a greater opportunity to participate in decisions about their future care and living arrangements.

“A family should look communities before there is a crisis,” Taylor said, as it is sometimes predictable that a family member, at some point in the future, might need to transition into an assisted living community or memory care. “It’s a big decision to make and it shouldn’t be made when a loved one is in a critical place.”

“We underestimate what our elders can contribute to discussions based on their rich memories and experiences,” Brar says. “Social connection isn't just good for the soul. It’s good medicine. For those in their 80s and 90s, maintaining meaningful relationships and community ties is directly associated with lower rates of cognitive decline, reduced inflammation and even longer survival.”

NEW YORK — The Justice Department sued Gov. Kathy Hochul’s administration Tuesday over its handling of a popular Medicaid home care program that enables over 200,000 New Yorkers to hire their own caregivers, court records show.

The civil lawsuit accuses state Health Commissioner James McDonald and Medicaid Director Amir Bassiri of making false or misleading statements about the consolidation of Medicaid’s consumer-directed personal assistance program, or CDPAP, under financial services company Public Partnerships LLC.

According to the Associated Press, New York’s Medicaid program cost $115.6 billion in FY 2025, provides health care for 1 in 3 New Yorkers and spends more per person than any other state’s Medicaid program.

The civil lawsuit names state Health Commissioner James McDonald and Medicaid Director Amir Bassiri.
