The Washington Department of Revenue explains that legislation effective January 1, 2026 changed the B&O tax treatment of investment income following the Antio court decision, including new rules for incidental investment income and deductions available to certain qualified persons. The Department is continuing to issue guidance on these changes, making it important for nonprofits with endowments, reserve funds, or significant investment portfolios to evaluate whether their investment income could be subject to Washington B&O tax and whether they qualify for available deductions.
