The groundbreaking decision by the Federal Trade Commission (FTC) to ban non-compete agreements is a huge policy shift that will influence both our local workforce and the broader business environment.

Legal and Compliance Aspects: For business owners, the shift means reevaluating employment strategies to protect proprietary information without relying on non-competes. Trade secrets and non-disclosure agreements remain viable options for safeguarding sensitive data. Additionally, the FTC has streamlined compliance by allowing employers to simply notify workers bound by existing non-competes that these agreements will no longer be enforced, providing model language to facilitate this communication.

Empowerment for Workers because the FTC's new rule liberates nearly 30 million workers from non-compete agreements, which hinder career mobility and suppress wages.

Boost for Businesses: By prohibiting non-competes, the FTC anticipates a 2.7% annual increase in new business formation, translating to over 8,500 new startups each year. This surge in entrepreneurship is expected to foster a more dynamic economy, with an estimated increase of up to 29,000 patents annually.

It is crucial for businesses to adapt to these changes proactively and for workers to understand their new rights and opportunities. If you have any questions or need guidance on navigating this new landscape, feel free to reach out. Let's make the most of this transformative time for Florida's economy and its workforce!

I am proud to announce that I was recently appointed by the President-elect of the Florida Bar, Gary S. Lesser, to the Florida Bar Media & Communications Law Committee. The committee is intended to provide Bar members a forum for sharing information about the law applicable to free speech and communications. The committee will explore topical legal issues pertaining to the full spectrum of communications methods, including print, broadcast, cable and emerging technologies. A second and equally important purpose of the committee is to promote better understanding between The Florida Bar and the news media, focusing attention upon mutual problems and developing amicable solutions to those problems.
