One of the most expensive compliance mistakes a business can make isn't always intentional—it starts with calling someone an "independent contractor" without evaluating the actual working relationship.

Worker classification isn't just paperwork. It affects payroll taxes, employee benefits, wage laws, and legal compliance. Misclassifying an employee as an independent contractor can result in back taxes, penalties, wage claims, and significant reputational damage.

Before classifying a worker, ask:

✔️ Who controls how and when the work is performed?
✔️ Is the worker operating an independent business with multiple clients?
✔️ Are they paid by project or by the hour?
✔️ Do they provide their own tools and make meaningful business investments?
✔️ Is the work integral to your business?

The answer isn't determined by a contract or job title alone. Federal agencies—and often state agencies with even stricter standards—look at the reality of the working relationship.

A few best practices:
• Evaluate the relationship, not just the agreement.
• Review both federal and state classification standards.
• Document the reasoning behind each classification decision.
• Revisit classifications as roles evolve over time.
• When in doubt, consult legal or HR professionals.
