There is so much confusion in the press regarding the cause of outrageous pricing of beef. If you are as confused as I am and you keep hearing that it is the political party in charge that is responsible, do a little research on your own and I think you will find that fake news is at it again with their TDS—
There is substantial evidence of alleged price manipulation, triggering massive civil class-action lawsuits and a widening federal criminal antitrust investigation. While federal authorities have not yet filed formal criminal charges, major meat processing giants have already paid hundreds of millions of dollars in civil settlements to resolve private allegations of colluding to inflate beef prices.
The investigation and legal battles center around the "Big Four" meatpackers—Tyson Foods, Cargill, JBS USA, and National Beef Packing Company—who collectively control roughly 85% of the U.S. beef processing market.
Civil Court Settlements and Class Actions
Private litigants and corporate buyers have uncovered enough evidence of anti-competitive practices to push through major legal victories:
• Class Certification: A federal judge certified class-action lawsuits brought by consumers, restaurants, and grocery buyers alleging price-fixing from 2014 to 2020.
• Multimillion-Dollar Payouts: Major processors settled parts of these lawsuits without admitting wrongdoing to avoid ongoing litigation costs.
• JBS: Settled civil claims for over $135 million across different purchaser classes.
• Tyson Foods: Settled direct and consumer claims for $137.5 million.
• Cargill: Agreed to a $32.5 million settlement for consumer claims.
• The Alleged Mechanism: Lawsuits claim packers artificially constrained beef supplies, reduced cattle purchases, and suppressed rancher pay to inflate their own profit margins.
Active Federal Criminal Investigation
The federal government has escalated its scrutiny into a full-scale criminal probe:
• DOJ Criminal Probe: The U.S. Department of Justice (DOJ) shifted its inquiry into a formal criminal antitrust investigation looking into bid-rigging and price-fixing.
• Massive Discovery: Investigators have reviewed more than 3 million corporate documents and interviewed hundreds of industry participants.
• Targeting Retailers: The probe expanded to include letters demanding pricing strategies, margins, and cost data from eight major grocery giants, including Walmart, Costco, Kroger, and Amazon.
Counterarguments and Market Realities
While the investigations continue, the meatpacking industry and agricultural economists point out that external factors also dictate record-high sticker prices:
• Historic Herd Shortages: Due to severe multi-year droughts and high feed costs, the U.S. cattle herd dropped to its lowest level in 75 years, heavily squeezing supply.
• Rising Input Costs: Meatpackers argue that elevated transportation, labor, and record-high live cattle purchase costs account for consumer pricing.
