💼 🇺🇸 H-1B Visa: The LCA, Petition, and Approval Stage Explained
Most people think the hardest part of the H-1B is the lottery. It is not.
The real work begins after selection. This is the stage where the case is built, filed, and approved. Get it right, and the path stays clear. Get it wrong, and even a strong candidate can be delayed for months.
Here is what this stage really involves.
✅ Step one: The Labor Condition Application (LCA)
Before any petition is filed, the employer must file a Labor Condition Application with the Department of Labor. This is done through the DOL FLAG System on Form ETA-9035 or 9035E.
The LCA protects U.S. and foreign workers. The employer promises to pay a fair wage and to keep working conditions fair.
Wages sit at the center of this step. Four things matter here:
✅ When the case is approved, USCIS issues Form I-797, the approval notice. That is the moment the H-1B becomes real.
✅ Employers who need speed can file Form I-907 for premium processing. In 2026, the H-1B premium processing fee is $2,965 as of March 1, 2026, and the H-1B premium processing time is 15 business days. One thing to remember. The fee does not guarantee approval; it guarantees adjudication speed.
The quiet truth about this stage
The forms are only paper. What decides the outcome is preparation.
Every wage number, every date, every job duty must line up. When they do, approval feels simple. When they do not, small gaps turn into big delays.
That is the part no portal can do for you.
