Special education placement and location are distinct concepts. Placement refers to the continuum of services based on the Least Restrictive Environment, whereas location denotes the specific setting where these services are delivered. For instance, a student's placement might be in a self-contained classroom, and the district's responsibility under IDEA is to provide the location for this placement. The placement determines the location, which may be within the home school or another building within the district.

I copied this from another page and can’t tell you how true it is! 👇

I know. FAPE is supposed to be free. And hiring an advocate is not pocket change.

But I can’t tell you how many times I’ve seen this play out the exact same way.

Parent: “We just can’t afford an advocate. We’re going to try to handle this on our own.”

Me: “Okay. Reach out if you change your mind.”

Then six months later. Sometimes a year. Sometimes on a Sunday. Once on Thanksgiving.

Same parent: “We need help. It’s bad.”

Now the child has been suspended repeatedly. Or arrested. Or hospitalized (as in 302'd or 5150). Or facing truancy court.

At that point, it’s not just an IEP issue anymore. It’s layered and complicated. It takes more time. It costs more money. And sometimes it involves attorneys outside of special education.

I have never, not once in 16 years, seen a prickly IEP situation fix itself without significant, meaningful advocacy.

If your gut is telling you something isn’t right, listen to it.

That doesn’t automatically mean you have to hire me. It might mean you dive into free resources. It might mean you learn everything you can and prepare differently for the next meeting. It might mean you bring a trusted support person.

Early support is almost always simpler, less expensive, and less painful than crisis management.

IEP and 504 transition time is here! Springtime is that time of year when parents will meet with staff for their child’s transition to kindergarten, middle, and high school. While these meetings can be fraught with anxiety, there is added stress with the uncertainty of this administration’s agenda for the DOE. Speculation concerning the future of our special needs community has further increased the need for parents to be engaged, informed, and well prepared. Conflict between parents and school is normal and inevitable. Parents want the "best"education for their children. Schools are only required to provide "appropriate" services for children with disabilities.
If you disagree with the IEP team's plan to educate your child, there are several options you can use to resolve the dispute.

*Negotiate and resolve the dispute informally through the IEP process.
*Request mediation.
*File a complaint with the state board of education.
*Request a due process hearing.

Special education is not a place. It’s individualized services and supports tailored to meet a child’s identified needs in the Least Restrictive Environment (LRE). Are your child’s needs being met? Happy to report that my clients just got their school district to revise their child’s placement to the (appropriate) least restrictive environment! This process started in May and was just finalized last week! This was not easy, and the frustrations, anxiety, and discord between family and district placed a heavy (not to mention expensive) toll on them. If you are the parent of a special needs child, don’t stop advocating. Remain diligent in fighting for what’s in your child’s best interest, and trust your gut. I always tell my clients, “You don’t know what you don’t know” and districts will not always be forthcoming with the information you need to make informed decisions. As an experienced advocate, I can help you sit at the IEP table with the confidence and tools you need to ensure your son or daughter receives appropriate services, accommodations, and modifications.
