The Freelancer Expense and Tax Relief Act (“FLEX ACT”) creates clear federal tax standards for legitimate independent business relationships, including a federal employment-tax safe harbor for qualifying arrangements, tax relief for independent service providers, and safeguards to prevent abuse.

Independent contractors and small transportation businesses are essential to the supply chain, yet they still face uncertainty around how these relationships are treated.

In meetings with House leadership, Ways and Means and Tax Subcommittee offices, the Republican Study Committee and more, the important components of the legislation were discussed with feedback. A path forward was also agreed upon.

The FLEX Act is still developing, but the conversation has moved to a legislative discussion. SCI and CLDA will keep everyone in the industry informed as it progresses.

SCI is in Washington, D.C., with support from the CLDA, to discuss the FLEX Act.

The FLEX Act is designed to establish a federal employment-tax safe harbor for qualifying independent contractor arrangements and provide an additional self-employment-tax deduction for qualifying contractors. Together, these provisions address tax treatment for both independent business owners and the companies that engage them.

The legislation also includes expanded information reporting to support tax compliance, limits on retroactive tax assessments in certain good-faith situations, and an optional pathway for states to adopt qualifying safe harbors for federal unemployment-tax purposes.

These meetings provide an opportunity to discuss all five provisions with congressional offices and gather feedback on the legislation. We’ll share updates as those conversations continue.

Behind every local delivery business are years of work, personal investment, and people who depend on it.

NYC’s proposed Intro 518 would require covered facilities to directly employ workers performing core delivery and warehouse services, generally eliminating the DSP and subcontractor model—even for local companies whose drivers are already W-2 employees.

For those business owners, losing a contract could mean losing their primary source of revenue. Business loans, vehicle payments, and personal guarantees may remain long after that revenue disappears.

And while safety is part of the bill’s justification, the cited research does not compare crash rates by employment model or establish that changing who employs a driver would make deliveries safer. A change with consequences this significant deserves evidence that directly supports the proposed solution.

SCI supports protecting local delivery businesses and advancing safety through informed, evidence-based policy. These owners deserve a voice in decisions that could determine their future.
