ATTENTION TEXAS

Texas Court opinion, service of process should continue and is not trumped by a shelter in place. This was emailed to me today.

Service of Process: A person’s right to process and a petitioner’s duty to give notice trumps the shelter in place order. Attorneys, get as much contact information from your clients as possible and pass that along to your process server. If there’s a phone number or email or social media account, give that information to your process server. In this time of flux, the mechanics of perfecting service should include knocking, the respondent person coming to the door, identifying themselves and placing the papers on the ground a safe distance in front of them, along with a video of the entire occurrence. The attorney or process server should also give the respondent notice by screen shots to their cell phones, email, social media, etc. – any way to assure that those respondents have actual notice.
