Balance billing = charging a patient the difference between your billed amount and what insurance paid.

Sounds straightforward. But the rules can be complicated 🫠

❌ Balance billing is generally not allowed for:
• In-network providers billing above the contracted rate
• Emergency services protected under the No Surprises Act
• Most Medicare and Medicaid services

✅ May be allowed for:
• Certain out-of-network services
• Non-covered services when the patient was informed in advance
• Services specifically excluded from a patient’s plan

📃The No Surprises Act protect patients from unexpected bills for:
-> Emergency Care
-> Most out-of-network providers at in-network facilities
-> Out-of-network air ambulance services

The rules vary by payer, state, and situation. Before billing a patient, make sure you understand what is actually their responsibility 🧐

Here’s how to handle it with confidence and kindness. Say this: « I completely understand that can feel unexpected. Your insurance plan includes a copay for office visits, it’s part of your benefit structure, not something we set. We do need to collect it at the time of service. »

Reminders:
• You’re required to collect copays otherwise it could be considered a compliance violation
• Stay calm and factual
• Offer a payment plan if the amount is hardship
• If they refuse entirely, document it and escalate it per your practice policy
