If you claim the Earned Income Tax Credit (EITC) or Additional Child Tax Credit (ACTC), the PATH Act will delay it.

The Protecting Americans from Tax Hikes (PATH) Act requires the IRS to hold refunds for taxpayers who claim the Earned Income Tax Credit (EITC) or Additional Child Tax Credit (ACTC) until after February 14, in order to prevent tax fraud.

The IRS will lift the PATH Act holding requirement on February 17, 2025, and fund most refunds of taxpayers claiming either the EITC or ACTC by February 28, 2025.

Additionally, other tax credits, such as the American Opportunity Tax Credit (AOTC) or Premium Tax Credit, may require additional documentation, slowing down refund processing.

Getting ready for the 2024 Tax Season and need to share some new items and reminders for this tax season.

First off thank you to all our tax clients for helping us grow beyond what I ever expected it to do way back when I started out on my own in 2002…

To start things off, there will be a slight increase in fees this season for some clients. Just can’t be help… 😔

ALSO STARTING THIS YEAR PLEASE DO NOT send ANY of your personal/business documents via Facebook or other social media outlets. We have a secure encrypted site for that. https://www.encyro.com/kaminskitaxservice

If you are a returning client, we encourage you to drop your information off. We now have a convenient door drop off slot that can be used 24/7/365. Please text me first though if using drop slot as you may have to fill out updated information forms at the time of drop off. You may also upload documents to my Encyro website https://www.encyro.com/kaminskitaxservice and I will send you if need be updated information forms to fill out and return.

When to expect your refund if you claimed the Earned Income Tax Credit, Additional Child Tax Credit or American Opportunity Tax Credit

If you claimed the EITC, ACTC or AOTC you can expect to get your refund by March 3 if:

You file your return online
You choose to get your refund by direct deposit
We found no issues with your return

However, some taxpayers may see their refunds a few days earlier.

Why we hold your refund
By law, we can’t issue EITC, ACTC, AOTC refunds before mid-February. This includes your entire refund, not just the part that’s related to the credit you claimed on your tax return…

“IRS announces delay in Form 1099-K reporting threshold for third-party platform payments for 2023; plans for a threshold of $5,000 in 2024 to phase in implementation

WASHINGTON — Following feedback from taxpayers, tax professionals and payment processors and to reduce taxpayer confusion, the Internal Revenue Service today released Notice 2023-74 announcing a delay of the new $600 Form 1099-K reporting threshold for third-party settlement organizations for calendar year 2023.

As the IRS continues to work to implement the new law, the agency will treat 2023 as an additional transition year. This will reduce the potential confusion caused by the distribution of an estimated 44 million Forms 1099-K sent to many taxpayers who wouldn’t expect one and may not have a tax obligation. As a result, reporting will not be required unless the taxpayer receives over $20,000 and has more than 200 transactions in 2023.

Given the complexity of the new provision, the large number of individual taxpayers affected and the need for stakeholders to have certainty with enough lead time, the IRS is planning for a threshold of $5,000 for tax year 2024 as part of a phase-in to implement the $600 reporting threshold enacted under the American Rescue Plan (ARP).”
