In a nutshell, mediation is conflict resolution, also called Alternative Dispute Resolution (ADR). Mediation can be formally defined as the intervention by a third party between two or more sides in a dispute in an attempt to help them reach an agreement. The “Mediator” is the third party that guides the participants in reaching a mutually satisfactory agreement. Mediators of disputes devote their
attention to the mediation process and using techniques, which allow the disputants to effectively negotiate with each other, identify, clarify and communicate the issues and interests in dispute, and structure a settlement that is fair and workable from their perspective. The mediator remains “neutral” in the process and the parties have the power to decide the outcome. Unlike arbitration or litigation, the mediation process is both voluntary, informal in nature and confidential. In arbitration or litigation, the decision is made by a third party (arbitrator or judge) and one party loses. Mediation is a win-win with the parties being in control and deciding the outcome. Plus, the process is less expensive and more expeditious. Throughout life, conflicts can arise due to the stresses of everyday living, misunderstandings and miscommunication. Mediation is for anyone who is living with the tension or “clash” with someone who would like to achieve some peace in the relationship and move forward.
