As we enter the 4th quarter of 2020, we need to be aware that the coming year will see significant regulatory changes in the EU. The revised EU Waste Framework Directive (WFD) comes into effect. By January 5, 2021, all companies doing business in or importing into the EU will be required to report articles containing SVHCs into the Substances of Concern In Products (SCIP) database.

Additionally, after a one-year delay due to COVID-19, the EU Medical Device Regulation (MDR) comes into effect on May 26, 2021.

On top of these new requirements, REACH and RoHS Directive will be updated throughout the coming year as well.

A new year brings new regulations. The International Fragrance Association (IFRA) has announced the notification of its 49th Amendment, leading to a recategorization of product classes.
Consumer products containing fragrance as part of their composition should make sure their products are in compliance with the IFRA 49th Amendment by February 2021 for new creations and by February 2022 for existing creations.

When does a cosmetic product become subject to the Federal Insecticide and Fungicide Act (FIFRA) as governed under the EPA?

The FIFRA statute gives the EPA authority to regulate the registration, production, distribution, sale and use of pesticides. FIFRA defines a pesticide, in part, as “any substance or mixture of substances intended for preventing, destroying, repelling or mitigating any pest”, while a “Pest is defined to broadly include any insect, rodent, nematode, fungus, w**d or any other form of terrestrial or aquatic plant or animal life or virus, bacteria or other microorganism.”

Any substance or product being sold or distributed that makes any such claim for pesticidal purposes, implies a pesticide use, consists of one or more pesticidal active ingredients, or possesses knowledge that the substance or product will be used as a pesticide, are all subject to FIFRA and must be registered unless otherwise exempted.
In addition to Federal Law (FIFRA), the registration and use of pesticides are also subject to state laws and regulations ,as pesticides must also be registered in each state or territory for which the product is to be sold.

All pesticide products are governed under FIFRA and are exempt from TSCA. The Global Harmonized System (GHS) is not incorporated into the FIFRA Labeling requirements by the EPA and are labeled in accordance with 40 CFR Part 156 for all components of the product.

An Interim Final Rule was established on February 27, 2019, the PHMSA (Office of Pipeline Hazardous Materials Administration) in conjunction with the FAA (Federal Aviation Administration). It prohibits the transport of lithium ion cells or batteries as cargo on passenger carrying aircraft. The Interim Final Rule also requires that lithium ion cells and batteries be shipped at no more than a 30% state of charge aboard Cargo Only Aircraft.

There is now just 1 month until the California Office of Environmental Health Hazard Assessment’s (OEHHA) revisions to its Proposition 65 (Prop 65) Article 6 “clear and reasonable warnings” regulations comes into effect. By August 30, 2018, companies MUST comply with the revised regulations for consumer product, occupational, and environmental exposures. While some companies have already revised warning requirements prior to this deadline, and an exception permits the prior warning language on consumer products manufactured before August 30, 2018, there remains a large majority of consumer products and other exposure scenarios that require detailed review and development of revised policies and warnings to ensure compliance with the new requirements.
