Your claim’s effective date can be locked in before you ever file the claim itself.

It’s called an Intent to File (VA Form 21-0966). Submit it, and you have a full 12 months to gather your evidence, get your nexus letter, and build the claim right — while your back pay clock starts running from the date VA received the ITF, not the date you finally hit “submit.”

The VA May Owe You Back Pay (Effective Dates)

⏳ THE VA MAY OWE YOU MORE THAN THIS MONTH’S CHECK. ⏳

✅ When your claim is approved, your money doesn’t start on the approval date — it starts on your effective date (38 CFR § 3.400). And that date is often far earlier than veterans realize.

📆 That gap between your effective date and your approval date? That’s retroactive back pay — sometimes months or years of it, paid in a lump sum.

👉🏾 VA VERY often grants the wrong effective date on granted claims so even if you filed and won your own claim(s) it is still very likely worth it to get an expert claims file review to ensure all effective dates are correct and that no CUEs still exist in your file.

A Claim Accuracy Request (CAR) lets accredited advocates flag an obvious error and ask the VA to fix it fast— without the wait time of one of the regular decision review options.

It's not a substitute for HLR, Supplemental Claims, or Board Appeals. It's a tactical scalpel for when the error is clear, the law is on your side, and you need it corrected fast.

When used right, CARs can:
✅ Correct effective date errors before they cost you years of back pay
✅ Catch overlooked claims and missed contentions
✅ Fix obvious math and rating calculation mistakes

A CAR must be submitted by an accredited advocate within 30 calendar days of the VA’s notification letter date. the VA aims to issue decisions on CARs within 30 days instead of the 125+ day average for standard reviews.
