It’s our favorite kind of Monday – ! This time the spotlight is on Maggie Underwood, our DOT Services Supervisor.

𝐐: 𝗪𝗵𝗮𝘁 𝗶𝘀 𝘆𝗼𝘂𝗿 𝗵𝗶𝘀𝘁𝗼𝗿𝘆 𝘄𝗶𝘁𝗵 𝗡𝗘𝗖𝗦?
𝐀: I started working at NECS on May 31st, 2022. Growing up, my father was a truck driver and has always maintained CDL, however, that’s about as far as my knowledge went regarding anything to do with DOT. What I have learned here at NECS has grown my expertise in the DOT field tremendously. It just goes to show that when you put time and effort into something, you can learn so much and grow with the knowledge.

𝐐: 𝐖𝐡𝐚𝐭 𝐤𝐢𝐧𝐝 𝐨𝐟 𝐬𝐮𝐜𝐜𝐞𝐬𝐬𝐞𝐬 𝐚𝐧𝐝 𝐜𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞𝐬 𝐡𝐚𝐯𝐞 𝐲𝐨𝐮 𝐟𝐚𝐜𝐞𝐝?
𝐀: After being an agent for close to 2 years, becoming a supervisor was a big leap for me but it has been very rewarding. Some of the challenges with this job is that regulation is always changing and there is always a different scenario for different situations. It’s not always black and white, but we will find the answer one way or another!

𝐀: I have a wonderful husband and 2 kids, so I love to do activities with my family. I love to fish, watch football with my husband, go to Holiday World with my kids, and be involved with our church on the worship team.

The DOT has withdrawn a direct final rule titled "Procedures for Transportation Workplace Drug and Alcohol Testing Programs" that would have gone into effect on August 5, 2024 due to adverse comments by the industry.

This withdrawal means that this rule will not become effective until the DOT has taken into consideration all public comments. It has no effect on the DOT's Oral Fluid Final Rule published on May 2, 2023 and effective June 1, 2023. While that rule is still effective, the industry is awaiting certified laboratories, qualified collectors and approved devices.

A proposed rulemaking issued at the same time as the direct final rule invited public comment and indicated the DFR would be withdrawn should adverse comments be made. Some concerns include:

👉 Cost of devices and collector training on multiple devices

👉 Establishment of temporary qualifications for collectors prior to the first laboratory being approved or waiting until after the first laboratory is approved (instead training collectors once first device is approved)

👉 Lowering standards of monitors of collector initial proficiency demonstration

Deaths from crashes involving at least one large truck fell 11% in 2023, according to the latest data from the FMCSA, hitting the lowest point in six years!

The drop in fatalities – from 5,417 in 2022 to 4,807 in 2023 – followed a corresponding 7% decrease in crashes overall that involved at least one large truck, which fell from 168,816 to 156,553.

Large truck crashes and fatalities spiked in 2021 during the height of the pandemic, but have come down in each of the past two years since. The 4,807 deaths in 2023 was the lowest since 2018, when FMCSA recorded 4,984 fatalities.

𝐐: 𝗪𝗵𝗮𝘁 𝗶𝘀 𝘆𝗼𝘂𝗿 𝗵𝗶𝘀𝘁𝗼𝗿𝘆 𝘄𝗶𝘁𝗵 𝗡𝗘𝗖𝗦?
𝐀: I have been with the company for 17 years. I started as a DOT Compliance Agent, then was promoted to Tax Recovery Services Supervisor. After earning my Enrolled Agent status in 2016, I was promoted to Fleet Tax Consultant. Each position has helped me learn more about the company and helped to create an overall picture of how NECS serves our various clients. Being an Enrolled Agent allows me to assist Vehicle Service agents with their clients by processing the Heavy Highway Use Tax. As an Enrolled Agent, I must take continual education classes to stay current with tax laws.

𝐐: 𝐖𝐡𝐚𝐭 𝐤𝐢𝐧𝐝 𝐨𝐟 𝐬𝐮𝐜𝐜𝐞𝐬𝐬𝐞𝐬 𝐚𝐧𝐝 𝐜𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞𝐬 𝐡𝐚𝐯𝐞 𝐲𝐨𝐮 𝐟𝐚𝐜𝐞𝐝?
𝐀: I challenge myself daily to be better than the day before. Some successes in the job have been to create processes and procedures to help improve the effectiveness and efficiency of responsibilities. A challenge I am currently facing is balancing work with home life while taking classes for my master's degree. I am intentional with my time, regardless of where or what I do. I very rarely back down from a challenge. A challenge allows me to learn and grow from the experience.

𝐀: I enjoy traveling with my husband, photography, and writing. I enjoy watching football and attending concerts. I volunteer with the youth group at my church and lead a women's bible study. I serve on the executive board of a non-profit organization that focuses on giving middle and high school students healthy alternatives to drug and alcohol use while also educating the community.

With the dust starting to settle after the landmark Supreme Court Chevron decision upended the federal rulemaking process, lawmakers are eager to hear about rules that small-business truckers would like to see challenged.

"I think first and foremost is the speed limiter rule that’s been floated around," said Lewie Pugh, executive vice president of the Owner-Operator Independent Drivers Association, testifying before the House Transportation and Infrastructure Committee.

The rule, which the FMCSA is looking to cap – potentially at as low as 60 mph for trucks – is scheduled to be published next year.

“Also, more flexibility in the hours-of-service [rules] would be very helpful, and eliminating the [Department of Labor’s] overtime exemption for driver pay,” Pugh said. “That was put in place in 1938. Truckers right now give away 20, 30 hours a week [due to trucking companies being exempt from having to pay drivers overtime]. That would also help manage the speed and other safety-related issues we’re talking about here.”

On June 21 the U.S. Department of Transportation issued a Direct Final Rule revising its drug testing regulations to provide for testing of oral fluid samples.

Under the rule, employers would have the option to test oral fluids in addition to or instead of urine samples to detect the presence of illegal drugs. This option is meant to help combat employee cheating on urine drug tests and provide a less intrusive means of achieving the safety goals of the program.

But they could only proceed with the Direct Final Rule if it was noncontroversial, i.e., the agency did not receive any negative comments. Because DOT received negative comments in the public docket, it has withdrawn the DFR and is proceeding to consider those public comments as part of the proposed rulemaking.

In general, the comments supported an oral fluid testing option but offered technical suggestions to improve the process.

𝐐: 𝗪𝗵𝗮𝘁 𝗶𝘀 𝘆𝗼𝘂𝗿 𝗵𝗶𝘀𝘁𝗼𝗿𝘆 𝘄𝗶𝘁𝗵 𝗡𝗘𝗖𝗦?
𝐀: This is my 31st year with NECS. I have had the pleasure of watching this company grow from 8 employees to the incredible staff we have now. I have a Bachelor’s Degree with a concentration in I.T. Management. Then in 2014 I completed a Master’s Degree in Administration with a concentration in Organizational Management. Contract Law was my favorite class and is helpful today with my role as Sales Operations Manager when I process and review our client agreements.

𝐐: 𝐖𝐡𝐚𝐭 𝐤𝐢𝐧𝐝 𝐨𝐟 𝐬𝐮𝐜𝐜𝐞𝐬𝐬𝐞𝐬 𝐚𝐧𝐝 𝐜𝐡𝐚𝐥𝐥𝐞𝐧𝐠𝐞𝐬 𝐡𝐚𝐯𝐞 𝐲𝐨𝐮 𝐟𝐚𝐜𝐞𝐝?
𝐀: I feel my biggest success has been overcoming my dread for change. Change must happen for growth to happen. It may be awkward or uncomfortable, but it is also very rewarding when new goals are achieved. My biggest personal challenge is that I am an A personality with a very high “J” rating. I strive for perfection (and beat myself up if I don’t feel what I am doing is perfect) and I expect it in others.

𝐐: 𝐖𝐡𝐚𝐭 𝐝𝐨 𝐲𝐨𝐮 𝐥𝐢𝐤𝐞 𝐭𝐨 𝐝𝐨 𝐨𝐮𝐭𝐬𝐢𝐝𝐞 𝐨𝐟 𝐰𝐨𝐫𝐤?
𝐀: Outside of work, I love my fur babies. I have a mini bernedoodle and a pekitzu. I love hanging out with my family and friends. I have a 22-year-old son. I enjoy pool time, a good competitive game of Euchre, and going on Jeep cruises with my friends. I also occasionally like a nice Netflix binge.
