Yesterday a federal appeals court limited agencies’ ability to attach ideological conditions to grants. On August 25, the Ninth Circuit largely upheld an injunction blocking HUD and DOT from conditioning transportation and homelessness grants on local governments adopting administration positions on immigration, transgender policy, and related issues. The court concluded that the agencies exceeded their statutory authority.
