EB-5 approval rate is 97% according to FOIA data as of January 2026. Here is what produces that figure.

EB-5 staggered payment applications are now under heightened government scrutiny, according to Aarushi Gupta of Donoso and Partners LLC.

For the past three to four months, the standard of proof required on staggered payment cases has grown more demanding. At the time of filing your initial petition, you must demonstrate a roadmap for the source of your anticipated future funds, not just documentation of what has already been invested. For investors converting local currency to US dollars, a complete trail of all currency exchange documents is required.

Haste makes waste in EB-5: when a petition is filed before it is ready and something goes wrong, it creates problems for everyone involved.

Rohit Turkhud of Chiesa Shahinian and Giantomasi PC (CSG Law) is direct: give your attorney the time they need to do it right. The application filed under pressure to meet a self-imposed deadline is the application most at risk. Readiness matters more than speed.

EB-5 HUA processing times: a legal tool has been reducing cases from 18 months to six to eight months for investors who use it correctly.

Aarushi Gupta of Donoso and Partners LLC explains this is a tool of necessity, not routine. All evidence must be in place. Any staggered payment supplementary filing must already be submitted. When used correctly, it creates a level playing field between HUA and rural EB-5 processing.

EB-5 source of funds: you must know where every dollar is coming from before you file. And you cannot change that source after filing.

Rohit Turkhud of Chiesa Shahinian and Giantomasi PC (CSG Law) explains that changing the declared source creates an immediate negative impact on the case. Of the 3% of adjudicated petitions that were denied, many are on appeal, with appellate bodies appearing to uphold the original denials.

EB-5 future instalment documentation now required by USCIS since July 2025: source of funds requirements have been extended to cover future investment amounts in staggered arrangements.

Ignacio Donoso of Donoso and Partners LLC explains that if you committed to completing your $800,000 in stages, USCIS marks the date you committed to and expects documented evidence of delivery. A roadmap for the rest of your funds is required at the time of filing, not just after the money arrives.
