IRS & Phishing

Phishing is a scam typically carried out with the help of unsolicited email or a fake website that poses as a legitimate site to lure in potential victims and prompt them to provide valuable personal and financial information. Armed with this information, a criminal can commit identity theft or financial theft.

If you receive an unsolicited email that appears to be from either the IRS or an organization closely linked to the IRS, such as the Electronic Federal Tax Payment System (EFTPS), report it by sending it to [email protected].

It is important to keep in mind the IRS does not initiate contact with taxpayers by email to request personal or financial information. This includes any type of electronic communication, such as text messages and social media channels. The IRS has information online that can help you protect yourself from email scams.

As a Notary, we can not notarize incomplete documents.

A notary public cannot take an acknowledgment on a document that is incomplete.
(California Government Code section 8205.) When presented with a document containing a signature to be notarized, the notary public should visually scan the document to determine if the
document is complete. Blank spaces and blank lines should be examined to ensure information is not missing. Also, if a notary public has experience with a particular type of document, and
knows what information should be stated in the document, and that information is missing or incomplete, the notary public must refuse to notarize the signature. (California Government
Code section 8205(a)(2).)

The 'Less But Not More' Rule

One of the most common identity issues occurs when a signer’s name in a document or their signature does not match the name on the identification document presented to you. When this happens, the best way to proceed is to apply the general rule of “less, but not more.” In other words, the name or signature on the document can be less than what appears on the ID, but not more.

For example, if the name on the ID card is “Jane A. Smith.” You may accept the name “Jane Smith,” “J.A. Smith” or “J. Smith” on the document and write that name on the notarial certificate. However, you should not accept “Jane Alice Smith” or “Jane Smith-Burns.

The only forms of identification (satisfactory evidence) you can use to identify a person appearing before you are listed in California Civil Code section 1185. Social security cards, student identification, consular identification cards, visas and voter registration cards, to name a few, are not acceptable forms of identification and cannot be used for notarial purposes.

If you ever wonder why your notary asks you for your thumb print.

While only two states — California and Illinois — require Notaries to record signers’ thumbprints for certain transactions, the NNA recommends that Notaries obtain a thumbprint from every signer because of its value in deterring fraud and providing evidence to law enforcement.

Have your signer touch a standard inking device with his or her right thumb and then touch the journal page to leave a print. Imprinting the right thumb is standard practice for law enforcement use, and as a biometric identifier in official IDs, such as driver’s licenses.
