🚨 Florida Medicaid Health Care Alert – Adult Day Care Moratorium 🚨

Effective May 1, 2026, the Florida Agency for Health Care Administration (AHCA), with approval from CMS, has imposed a temporary 6-month Medicaid moratorium on the enrollment of new and pending Adult Day Care Providers in Miami-Dade County.

This means:

* No new Medicaid Adult Day Care enrollments will be approved in Miami-Dade County during the moratorium period.
* Pending applications for Adult Day Care Providers will not be approved at this time.
* Existing enrolled Adult Day Care Providers may continue to provide and bill for authorized services.
* Current providers also cannot add the Adult Day Care specialty (113) to an existing Provider Type 67 file during the moratorium.

AHCA states the purpose of the moratorium is to:
βœ”οΈ Combat fraud
βœ”οΈ Protect taxpayer dollars
βœ”οΈ Maintain access to quality patient care

This action was authorized under the Affordable Care Act and approved by the Centers for Medicare & Medicaid Services (CMS).

πŸ“Œ Important Note:
Recipients will continue receiving necessary services, and existing providers remain operational.

🚨 BREAKING NEWS FOR HOSPICE & HOME HEALTH 🚨

The Centers for Medicare & Medicaid Services (CMS) has announced a nationwide 6-month moratorium on NEW Medicare enrollments for Hospice and Home Health Agencies due to concerns regarding fraud, waste, and abuse within the industry.

What does this mean? πŸ‘‡

βœ… Existing hospice and home health agencies already enrolled in Medicare will continue operating as normal.

❌ New agencies seeking Medicare enrollment during this period will not be able to apply for enrollment approval for the next 6 months.

⚠️ This also may impact certain majority ownership changes for agencies that require a new enrollment application.

CMS stated this temporary pause is intended to strengthen oversight, investigate fraudulent activity, and protect Medicare beneficiaries and taxpayer dollars.

This DOES NOT stop agencies that have:
β€’ Already completed enrollment
β€’ Already received approval
β€’ Already gone through the licensing and certification process

However, individuals planning to open a new Medicare-certified Hospice or Home Health Agency should expect delays until the moratorium is lifted or revised.

According to CMS, the moratorium may be extended if deemed necessary.

πŸ“’ Home Health Agency Owners Let’s Talk 1099s & Taxes

If your home health agency works with 1099 independent contractors, tax time looks very different than W-2 payroll and misunderstanding it can cost you πŸ’Έ or trigger IRS issues.

Here’s what every agency owner (and contractor) should know πŸ‘‡

βœ… 1099 contractors are NOT employees
βœ”οΈ No payroll taxes withheld
βœ”οΈ No employer-paid F**A
βœ”οΈ Contractors are responsible for their own taxes

πŸ’° How 1099 contractors should pay taxes
β€’ Quarterly estimated taxes (IRS Form 1040-ES)
β€’ Self-employment tax (Social Security + Medicare)
β€’ Federal income tax (and state, if applicable)

πŸ“„ Agency responsibilities
β€’ Issue Form 1099-NEC by January 31
β€’ Do NOT reimburse personal taxes
β€’ Maintain clear independent contractor agreements
β€’ Avoid misclassification (this is BIG πŸ‘€)

🚨 Common mistakes we see
❌ Paying contractors like employees
❌ No written contract
❌ No 1099 issued
❌ No education provided to contractors

✨ Pro Tip for Agency Owners:
Educating your contractors protects YOUR business.
Clear policies = fewer disputes, audits, and headaches.
