OFCCP has rescinded the 2006 Compensation Guidelines with Directive 307. According to Pat Shui the OFCCP Director the 2006 guidelines has hampered their efforts to combat pay discrimination. They are also announcing new guidance to explain how this agency will investigate such discrimination going forward. Both of these actions will take effect on Thursday, February 28, 2013.

The rescission is formalizing what OFCCP has been doing in audits for some time without OMB approval. This gives OFCCP a wide range of tools to analyze federal contractor pay in an audit.

It will be interesting to see how much OFCCP will share in what compensation trigger tests the employer can conduct to mirror what the agency will perform. In the past, OFCCP has not been willing to tell employers what to do prior to an audit to identify any problem areas. This seems counter productive if the goal is for employers to ensure there is not pay discrimination. I hope OFCCP will share their specific protocols.

SHRM has notified has selected me as a speaker for the SHRM annul conference in Chicago, June 23-26, 2013. Also I was selected to speak at the ARK SHRM HR Conference in Hot Springs, Ark. April 16-19, 2013. I am excited and honored.
