Between the expiration of various publisher licenses and the "divest-or-ban" bill heading to the Senate next week for a vote, the music discovery landscape in the US could look very different very soon

The model TikTok license used by many independent music publishers, as negotiated by the NMPA, is set to expire at the end of April.

If the MLC is successful in reclassifying Pandora's core service as interactive, songwriters and publishers should expect a very nice uptick in income

Pandora has responded to a lawsuit filed by collecting society MLC in a dispute over whether or not the streaming platform’s personalised radio service should be classified as interactive or non-interactive. Pandora says not only is the MLC’s position on this wrong, it shouldn’t even have a po...

Most funds are focused on a quick exit, yet Kobalt is going back to their roots and adopting a long-term hold strategy. With only a few independent players with this model, it will be interesting to see them maneuver as the market consolidates.

This marks Kobalt’s return to managing investment for outside capital after selling its two Kobalt Capital funds in recent years.

Richard Busch is suing for Right of Publicity. If this makes it to court, it seems like a sure win.

The new lawsuit raises big questions about what can legally be borrowed from older songs, even when some licenses are secured.

A huge win for UMG, as well as the other major labels. A losing verdict would still hurt UMG in the way of precedent, however they seem to have avoided worst-case scenario as any future claims would be heavily reliant on individualized evidence.

The case claims UMG has “systematically” rejected termination notices from hundreds of artists, but a judge says each musician will need bring their own case.

Digital usage continues to increase at roughly the same healthy rate as previous years. And while this inherently brings improved margins, what's new is that increased subscription prices mean streaming is becoming even more valuable.

More digital consumption — from a multitude of sources — and improving margins are positive news for catalog valuations.

Good news for the continued catalog boom- due to legislative gridlock, the beneficial capital gains rates provided to songwriters is likely to remain for at least the next several years.

In recent years, music catalogs have turned into stable and accessible income-generating assets. Manatt, Phelps & Phillips LLP’s Beau Stapleton and Burak Ahmed look at the tax advantages that artists get from Section 1221(b)(3) of the tax code, which allows for capital gains treatment on the s...

Very interesting that the NMPA isn't completely in agreement with the Copyright Office but instead pushing for a non-retroactive legislative solution. 99% of the time, the interests of the publishers and songwriters are aligned... this falls into that 1%

Signed by Sheryl Crow, John Mayer and many others, the letter warns that any opposition to the proposed new rule would be “a vote against songwriters.”

Licenses-in-effect be damned! The copyright office has proposed a rule whereby licenses to streaming services are not considered derivative works in order to ensure that terminated publishers are no longer entitled to post-termination royalties

Regulators want to clear up uncertainty about who gets paid streaming royalties when songwriters take back their music rights – a trickier question than it sounds.

Prince vs Warhol: the Supreme Court is hearing its first fair use case since 1991's landmark decision upholding 2 Live Crew's raunchy parody of Roy Orbison's "Pretty Woman". Like the Pretty Woman case, this is sure to have wide-reaching repercussions

Will the case make “countless” works illegal? Or effectively make copyright law meaningless? The high court heard both arguments.

Another high-profile Marvin Gaye infringement case heads to court - the perfect opportunity for the pendulum to swing back after Blurred Lines marked open season on infringement

A federal judge refused to toss the case out, ruling that a jury might decide that “Thinking Out Loud” infringed Gaye’s iconic “Let’s Get It On.”
