Les rendez-vous pour les visas d’immigrant (demandes de carte verte effectuées à travers les consulats à l’étranger) ont été mis en pause au niveau mondial depuis quelques jours, et ce jusqu’à nouvel ordre, afin de permettre notamment le renforcement des mesures de vérification et de contrôle des demandeurs.

Cette annonce intervient quelques jours après la décision d’un juge fédéral de suspendre l'ordre executif de l’administration qui avait bloqué le traitement des demandes de visas d’immigrant pour les ressortissants de 75 pays. À la suite de cette décision, le Département d’État a mis en place une pause des rendez-vous pour les visas d’immigrant dans les ambassades et consulats américains à travers le monde entier.

Immigrant visa appointments (green card applications processed through U.S. consulates abroad) have been temporarily paused worldwide for the past few days, until further notice, in order to strengthen screening and vetting measures for applicants.

The announcement comes just days after a federal judge struck down the administration’s policy that had suspended immigrant visa processing for nationals of 75 countries. Following that decision, the Department of State implemented a worldwide pause on immigrant visa appointments at U.S. embassies and consulates.

USCIS is moving toward mandatory online filing. A new DHS rule authorizes USCIS to require certain immigration forms to be filed electronically after they have been available online for 180 days (which is the case already for naturalization, green card renewals, I-130 for family sponsoring, and extension of stay I-539 to name a few), or for any form after a 60 day public notice. Applicants and employers should prepare for an increasingly digital immigration process.

Une nouvelle réglementation du DHS autorise l'USCIS à exiger que certains formulaires d'immigration soient déposés électroniquement après avoir été disponibles en ligne pendant 180 jours (ce qui est déjà le cas, notamment, pour les demandes de naturalisation, le renouvellement de la Green Card, le formulaire I-130 pour le regroupement familial et le formulaire I-539 pour les demandes de prolongation de séjour ) ou pour tout formulaire après un préavis public de 60 jours.

⚠️ Nouvelle règle pour les demandes de Green Card

À partir du 18 septembre, l’USCIS change a nouveau sa définition de « public charge ». Il s'agit d'une définition beaucoup plus large de la notion de « public charge », donnant ainsi aux agents de l'USCIS une marge d'appréciation plus importante pour refuser une demande. Si vous envisagez de déposer une demande d’Adjustment of Status, la date de dépôt peut être importante en fonction de votre situation spécifique, de vos ressources, votre âge, et votre utilisation de bénéfice sociaux.

AVANT LE 18 SEPTEMBRE :
L'USCIS prend en compte uniquement :
☑️ Les aides financières destinées à assurer un revenu minimum (le SSI, le TANF et les programmes d'aide financière des États destinés au maintien des revenus, communément appelés General Assistance -GA)
☑️ La prise en charge par l'État d'une institutionnalisation de longue durée
Les bons alimentaires (Food Stamps), les aides non financières telles que certaines aides au logement, ainsi que certains programmes d'aide au niveau des états tels que SNAP et CHIP, et Medicaid (assurance médicale sauf en cas d'une institutionnalisation de longue durée), n'étaient pas pris en compte. Cela va changer.

À PARTIR DU 18 SEPTEMBRE :
L'USCIS disposera d'une marge d'appréciation beaucoup plus large et pourra prendre en compte :
☑️ Medicaid
☑️ SNAP / Food Stamps
☑️ Les aides au logement
☑️ D'autres aides publiques soumises à conditions de ressources
En plus des éléments suivants :
☑️ Les revenus et les actifs
☑️ La situation professionnelle

⚠️ New Green Card Rule

Starting September 18, USCIS will apply a broader “public charge” test to green card applicants. This is a much broader “public charge” which means more discretion for agents to deny cases. If you are preparing to file an Adjustment of Status application, the timing of your filing may be important, consult with an immigration attorney to determine how the new rule could affect your case.

BEFORE SEPTEMBER 18:
USCIS generally considers only:
☑️ Cash assistance for income maintenance (SSI, TANF, and State cash benefit programs for income maintenance, commonly called General Assistance - GA)
☑️ Government-funded long-term institutionalization
Food stamps, noncash assistance like housing programs, certain state cash assistance like SNAP, CHIP, and ordinary Medicaid (outside of long-term institutionalization) were NOT considered. This is changing.

ON/AFTER SEPTEMBER 18:
USCIS will have broader discretion to consider, as part of the totality of the circumstances:
☑️ Medicaid
☑️ SNAP / Food Stamps
☑️ housing assistance
☑️ Other means-tested public benefits,
In addition to:
☑️ Income, assets, employment, education, age, health and family circumstances

⚠️ Travel Advisory

There is an increase in ICE enforcement at U.S. airports (even for domestic travel, which was not a concerned before), with reports of individuals being arrested including some who have pending Adjustment of Status (green card) applications so are in a period of authorized stay (not "illegal").

Remember that a pending green card application does not guarantee protection from ICE arrest and detention.

So whenever possible, we recommend renewing your underlying nonimmigrant status (to maintain a valid I-94) while your application is pending. If your underlying status/I-94 has expired you should consult with an immigration attorney, and avoid non-essential travels including domestically. Your US ID is no longer sufficient, as ICE are now regularly at the airports. Always carry copies of your immigration documents and receipt notice for AOS when traveling.

Nous constatons une augmentation des contrôles et interventions de l'ICE dans les aéroports américains, y compris pour les vols intérieurs, ce qui n'était pas le cas avant. If you have an interview in the upcoming week, we will need to put together a "discretionary packet" for the USCIS, to help the agent make a favorable decision, until this memo is challenged in court. The new memo requires the officer to weight negative factors against positive factors.

Negative factors include:
- Violations of U.S. immigration law or the conditions of a prior visa status (working illegally, overtaying)
- Fraud or false statements made to USCIS or any other government agency
- Behavior that was inconsistent with the purpose of the visa or status you entered (getting married just after entering on a non-immigrant visa, or having pre-existing intent to apply at time of entry).
- Remaining in the U.S. after your authorized stay ended (overstaying)
- Having applied for adjustment of status when consular processing abroad was available to you (this one is NEW, this was not a negative factor in the past).

On the other side, the positive factors are:
- Strong family ties to the United States (a U.S. citizen or green card holder spouse or child particularly when separation would cause significant hardship)
- A history of lawful presence (consistent employment, tax filings)
- Good moral character (clean criminal record, charitable contributions, civic involvement, and letters from community members)
- Economic factors: Benefit to the United States, such as skills, contributions to the economy, history of employment, fluency in english, diplomas.

Un récent décret de l’immigration américaine « USCIS » en date du 22 mai 2026, qui vise à limiter le droit de déposer une demande de carte aux Etats-Unis suscite beaucoup d'inquiétudes, et ce, à juste titre. Cependant, le consensus général parmi les avocats spécialisés en droit de l'immigration est que cette note n'interdit pas le dépôt d'une demande d'ajustement de statut (AOS). La loi n'a pas changée. En revanche, ce memo établit un critère discrétionnaire nettement plus exigeant pour l'approbation. Selon toute vraisemblance, les demandeurs devront démontrer des facteurs positifs justifiant l'approbation de leur dossier, notamment démontrer leur capacité à exercer un emploi en soumettant, entre autres, leurs diplômes et/ou des preuves d'expérience professionnelle, potentiellement une offre d'emploi, ainsi qu'une preuve de maîtrise de l'anglais. D'autres facteurs positifs comprennent une longue durée de résidence aux États-Unis et des liens familiaux sur le territoire américain. Les exigences probatoires restent toutefois soumises à l'appréciation de l'USCIS et sont susceptibles d'évoluer. Les demandeurs qui ne sont pas en conformité avec leur statut d'immigration se trouveront dans une situation plus difficile et devront vraisemblablement justifier des raisons pour lesquelles ils ont dépassé la durée de validité de leur visa, ainsi que les raisons pour lesquelles ils ont choisi de déposer leur demande depuis les États-Unis plutôt que de la traiter au consulat à l'étranger.

A recent USCIS Policy Memorandum dated May 22, 2026, which seeks to limit the right to apply for a green card in the United States is unsettling a lot of people, and rightly so. However, the general consensus among immigration attorneys is that this memorandum does not prohibit the filing of AOS application. The law has not changed. Instead, it establishes a significantly heightened discretionary standard for approval. In all likelihood, applicants will be expected to demonstrate positive factors that warrants approval such as their capacity for employment by submitting, among other things, their diplomas and/or evidence of professional experience, potentially a job offer, proof of fluency in English. This list is illustrative and not exhaustive, other positive factors include history of long duration of residence, and family ties in the U.S, but evidentiary requirements remain subject to USCIS discretion and may evolve as further implementation guidance is issued. Applicants who are not in compliance with their immigration status will be in a more challenging situation and will likely have to justify why they overstayed their visa, and why they decided to apply from the U.S instead of doing it at the consulate abroad.
