Your Child’s DNA and New Jersey Law

The Assembly’s judiciary committee is trying to do the right thing when it comes to safeguarding the DNA of New Jersey babies — will their colleagues join them?

The panel yesterday advanced a bill that would largely require New Jersey to use blood samples it takes from every baby born here to be used only for disease screening. The bill comes as the state faces criticism for its now-not-secret approval of law enforcement using the samples to connect the baby’s parents to crimes.

Now, the bill doesn’t bar law enforcement from accessing the blood samples at all, which I think would be the way to go, but it does offer some limits that aren’t in place now. Still, the same committee advanced a similar bill in the Legislature’s last session and it went nowhere.

“We might be dissuading people from the life-saving testing they need, or the justice they demand, if parents or victims and witnesses know their DNA is used in ways they didn’t consent to,” bill sponsor Assemblyman Michael Inganamort (R-Morris) said. “Sidestepping the protections guaranteed in the Constitution is a form of lawlessness. Two wrongs do not make a right.”

The bill comes after two lawsuits over the state's secret storage of more than a million babies' DNA long after disease-screening was done.
