Section 301 China tariffs: The Original 2018 Actions Remain in Effect

On October 7, USTR confirmed that the first two Section 301 tariff actions on Chinese goods, from July 6, 2018 (List 1) and August 23, 2018 (List 2), did NOT expire at their second four-year mark.

Why: under the Trade Act, these actions end on their four-year anniversary unless a U.S. industry that benefits asks for them to continue. USTR received 162 continuation requests from domestic producers and trade associations across both actions, so the tariffs stay in place.

What's next: USTR will open a full statutory review and publish separate notice(s) inviting public comments on how effective the tariffs have been, possible alternatives, and their impact on the U.S. economy and consumers.

What this means for importers:

US imposes new 25% tariffs on Brazil, expands exemptions list

July 15 (Reuters) - The U.S. has announced 25% duties on many imports from Brazil, while unveiling ​a broader-than-expected list of exemptions, reviving a trade war that could embroil dozens of countries around the world as the Trump administration reworks its tariffs ‌policy, one of its signature diplomatic tools.
The late-night announcement by the office of the U.S. Trade Representative made Brazil the first country targeted under the Trump administration's new tariff strategy, which relies on Section 301 of U.S. trade law, a provision that authorizes investigations into alleged unfair trade practices, to justify new levies on dozens of countries.

WASHINGTON – Today, the United States Trade Representative determined under Section 301 of the Trade Act of 1974 that certain of Brazil’s acts, policies, and practices related to digital trade and electronic payment services; unfair, preferential tariffs; anti-corruption enforcement; intellectual property protection; ethanol market access; and illegal deforestation are unreasonable and burden or restrict U.S. commerce, and are thus actionable under Section 301(b) of the Trade Act.

CIT Strikes Down Section 122 Tariffs: What This Means for Businesses

On the afternoon of May 7, 2026, the U.S. Court of International Trade (CIT) issued a significant decision invalidating the Trump Administration’s 10% global tariff imposed under Section 122 of the Trade Act of 1974. In State of Oregon et al. v. United States and companion cases, the court granted summary judgment for certain importer plaintiffs and permanently enjoined enforcement of the tariffs as unlawful. The Court found that only importers and not states had standing to challenge this action and limited the relief to those importer plaintiffs in Court. This relief, while precedential, does not apply at this time to anyone not in this court case. In order to benefit, it appears that entities will need to file their own case seeking similar relief.
