Yesterday was a big day for Kuvin Law. The US Supreme Court held that private employees cannot be discriminated against based upon their s*xual orientation. My office got involved in this in 2015 when my client and I cornered the federal government (with the help of the EEOC) into acknowledging that Title VII protected federal employees against s*xual orientation discrimination. The decision we received was cited by the US Supreme Court and by all of the parties involved. The next logical step was to take the law we created and for the same principle to be applied to private employees. That is what you saw yesterday. Way to go David Baldwin. You set out to change the law, and you did.

Inspired by the civil rights movement, it was decades in the making.

The DOL has reported that: Salaried workers exempt from being paid overtime, if mandated by their employers to stay home, must be paid in full even if they complete only a partial week’s work. Non-exempt workers are not similarly protected. Under the Fair Labor Standards Act (FLSA), employers need only pay non-exempt employees for hours worked, regardless of whether they had been scheduled to work additional time.

Kuvin Law is heading to the US Supreme Court. Our decision in Baldwin v. FAA is the cornerstone of two recent opinions that held that s*xual orientation discrimination is covered by Title VII and is unlawful.

The justices must decide if a law that forbids employment discrimination based on s*x also bars discrimination based on s*xual orientation or transgender status.
