THIS IS IMPORTANT! Please read, especially if you have a Georgia Weapons Carry License and carry a firearm for protection of yourself and others.

The Georgia legislature and Gov. Brian Kemp have decided that they would rather an armed citizen shoot and possibly kill someone robbing a little old lady than detain said robber at gunpoint (or not at gunpoint) and wait for the police arrive.

Let me break this down for you. Under Georgia's laws on the use of deadly force, you are justified in using deadly force to stop the commission of a "forcible felony." Robbery is a forcible felony. So if I walk out of Kroger at 10 PM and see a little old lady getting robbed in the parking lot, I am justified under Georgia law to shoot the robber to stop the robbery. I don't have to warn him or anything...just pull out my gun and shoot him.

Prior to today, I would also be justified in pointing my gun at the robber, ordering him to stop and get on the ground, calling 911, and detaining him until police arrived to take him into custody. This was made possible under Georgia's "citizen's arrest" statute.

In a knee-jerk reaction to the Ahmaud Arbery shooting in Brunswick, the legislature and Gov. Kemp have repealed Georgia's citizen's arrest statute because some people think that is going to allow Ahmaud Arbery's killers to go free. The men who killed him, based on what I know about the case, were not at all justified in using deadly force against him, so the citizen's arrest statute isn't going to help them.

So, to summarize, under current Georgia law as of May 11, 2021, you can no longer detain an individual who you catch in the act of committing a forcible felony (or any other crime for that matter), unless you are the owner of a retail establishment or restaurant and are detaining someone for shoplifting or theft by taking (not forcible felonies, BTW). You can, however, shoot someone who is actively committing a forcible felony (potentially killing them).

Makes a lot of sense, doesn't it?

The FBI's Uniform Crime Report for 2019 is out. There is a wealth of information to be gleaned from it, but among the most interesting data is the fact that in 2019, armed citizens lawfully shot and killed as many assailants and others in the acts of committing felonies as police officers did.

Also, as those of us in the fi****ms community know, the data once again shows that as gun ownership increases, violent crime decreases.

Gun rights activists now have fresh data from a reliable source to use against the gun prohibition lobby.
