The ridiculous outdated 4 page plea petition won't go away for gross misdemeanors in spite of the Supreme Court's rule amendment effective 8/1/2012 adopting a new form. Guess that's what happens when someone orders 10,000 extra copies from the printer!!!

I hope all my defense attorney friends will read the majority AND dissenting opinion in Maryland v King (issued June 3). If suspicionless cheek swabs (entering the body) are lawful, then certainly asking someone to blow into a tube based on probable cause for relevant evidence is lawful (search incident to arrest, like I have been saying).

To my lawyer friends: if you approach me as a prosecutor asking me to reduce the charge, I suggest you not have a completed plea petition to the original charge laying on top of your file. Just good negotiating advice!
