Frequently Asked Question Now Answered 👌

If you are applying for an immigrant visa for your minor child after a divorce, you may need the consent of your ex-spouse before you can take the child out of the country.

This is because the U.S. government recognizes that both parents have an interest in the child's well-being, and wants to ensure that both parents are consulted before the child leaves the country.

Depending on the circumstances of your case, you may be required to provide proof of your ex-spouse's consent before your child's visa can be approved.

So! Yes you will be asked to present evidence that you have been granted full sole custody by the court or a notarized letter from your ex-spouse if the parents named on the child's birth certificate are not immigrating to the United States.

Ever heard of a re-entry permit?

A reentry permit, also known as a travel document, is a document that allows a foreign national who is in the United States to reenter the country after traveling abroad.

The permit is issued by the U.S. Citizenship and Immigration Services (USCIS), and is valid for a period of two years.

A reentry permit can be obtained by filing Form I-131, Application for Travel Document, with the USCIS. Applicants must meet certain eligibility requirements, including having a valid reason for leaving the country, such as family or business obligations.
