"Adverse action" is the legal term for rejecting, rescinding an offer, or demoting someone based on their background check.

And if you take adverse action, you MUST follow a specific process, or you could be sued.

Here's what FCRA requires:

✅ Step 1: Send a pre-adverse action notice
Before you reject someone, you must notify them in writing that their background check influenced your decision.

✅ Step 2: Provide a copy of the report
Give the candidate a copy of the background check report so they know what was found.

✅ Step 3: Include a summary of their rights
Attach a document explaining their right to dispute inaccurate information.

✅Step 4: Wait a reasonable amount of time
Give the candidate time to review the report and dispute errors before making your final decision (typically 5–7 business days).

✅ Step 5: Send a final adverse action notice
Once you've made your final decision, notify the candidate again in writing.

Skipping these steps = FCRA violations = lawsuits, fines, and reputational damage. Even if the background check findings are accurate, improper adverse action procedures can get you sued.
