The Pregnancy Workers Fairness Act (PWFA) has been signed into law by President Biden and will be added to the list of federal labor laws, effective 6/27/2023.

The PWFA applies to employers with 15 or more employees and protects all employees, including part-time, temporary, and seasonal workers. The Act also protects job applicants.

Under the PWFA, reasonable accommodations necessitated by pregnancy, childbirth, or related medical conditions are required unless doing so would impose an undue hardship on the employer. Furthermore, the PWFA makes retaliating against covered employees who need or request reasonable accommodation illegal.

The EEOC will issue guidance that includes examples of reasonable accommodations. This guidance is expected within the next year. For now, here are some examples:

Light-duty assignments; additional or longer break periods; flexible work arrangements; flexible work schedules; providing equipment or resources; allowing time off for bed rest during pregnancy or for recovery after childbirth; providing a private space that is not a bathroom for lactation.

If you claim an undue hardship, you must be able to support such. Factors to consider when assessing undue hardships are your employment size and financial resources related to the requested accommodation.

To minimize the risk associated with PWFA non-compliance, you should avoid company-wide rules or decisions related to accommodations and handle pregnancy-related accommodation requests on a case-by-case basis.

Start familiarizing yourself with the Act’s requirements and establish a process to ensure compliance. This should include a process for handling and assessing accommodation requests, including having interactive discussions with employees requesting accommodation.

This report contains demographic workforce data, including data by race/ethnicity, gender, and job categories. EEO-1 filing is required under section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e-8(c), and 29 CFR 1602.7-.14 and 41 CFR 60-1.7(a).
