⚖️ BREAKING THE CHAINS: The New Mandatory Minimum Sentencing Relief Law
For decades, New York's mandatory minimum laws acted as a conveyor belt to maximum-security prisons. If our loved ones were charged with certain offenses, judges were legally blocked from looking at the human being in front of them—they were forced by the state to hand down an extreme minimum prison term, regardless of the individual circumstances.
This new law changes that completely.

Restores Discretion to the Courts: When all parties (the defense and the prosecution) and the court agree as part of a plea bargain, the strict statutory minimum sentences can be entirely removed.
Focuses on Individual Accountability: Instead of incarceration being treated as the only tool available, prosecutors and judges now have the legal power to substitute prison time with treatment, specialized programs, and community-based interventions.
As Insha Rahman, president of the Vera Institute, stated: "Giving the courts discretion to avoid some mandatory minimum prison sentences... allows prosecutors and judges to consider each case on the individualized circumstances of the crime. The best investment in safety is giving individuals the tools to turn their lives around."

In the old system, prosecutors used the threat of mandatory minimums as a weapon to bully our loved ones into taking terrible plea deals out of pure terror. By giving the courts the legal authority to bypass those minimums, it opens a brand-new door for true justice, customized rehabilitation, and drastically shorter sentences.
