DEPARTMENT OF BUILDINGS ADVISES PROPERTY OWNERS, CONTRACTORS, & CRANE OPERATORS TO TAKE PRECAUTIONARY MEASURES DURING SEVERE WEATHER

The New York City area may experience severe weather including heavy rain and high winds with potential wind gusts of up to 40 MPH, starting 6 p.m. on Saturday, March 9, with high winds continuing until Tuesday, March 12. Accordingly, DOB is reminding all builders, contractors, crane operators, and property owners to secure their construction sites, buildings, and equipment.

The Department will be performing random spot-check inspections of construction sites around the city. If sites are not secured, the Department will take immediate enforcement action -- issuing violations and Stop Work Orders, where necessary.
Winds may reach higher speeds and last longer than forecast in certain areas of the city. Property owners must consider the safety of their buildings and construction sites, including cranes, suspended and supported scaffolding, hoists, and any other building appurtenances that may come loose from exposure to high winds. Structures that have been subject to deferred maintenance or are in delicate condition could be at greater risk. The Department suggests consulting a professional to advise how to secure construction sites and buildings.
To safeguard construction sites, builders, contractors, and developers should take all precautionary measures including but not limited to the following:
• Tie down and secure material and loose debris at construction sites.
• Cover electrical equipment from exposure to the weather.
• Store loose tools, oil cans, and extra fuses in a toolbox.
• Secure netting, scaffolding, and sidewalk sheds.
• Suspend crane operations and secure crane equipment when wind speeds reach 30 mph or greater.
• Suspend hoist operations and secure exterior hoists when wind speeds reach 35 mph or greater, unless manufacturer specifications state otherwise.
• Brace and secure construction fences.
• Call 911 if there is an emergency on a construction site.
Buildings Bulletin 2015-029 outlines the requirements for vertical netting, debris netting and material-fall protection devices at buildings and construction sites.
To secure a building, property owners should take all precautionary measures including but not limited to the following:
• Bring inside loose, lightweight objects such as lawn furniture, potted plants, garbage cans, garden tools, and toys.
• Anchor objects that would be unsafe outside, such as gas grills or propane tanks.
• Close up and secure patio umbrellas.
• Secure retractable awnings.
• Remove aerial antennas and satellite television dishes.
• Take down tents or follow manufacturer’s instructions to secure them.
• Check to ensure all gutters, roof drains, and down spouts are cleared of debris to allow for proper drainage.
New Yorkers are encouraged to call 311 to report non-compliant conditions or 911 to report emergencies at construction sites or buildings. New Yorkers who suspect a building or property has been structurally compromised should call 911.
Under §28-301.1 of the Administrative Code of the City of New York, property owners are legally obligated to maintain their properties in a safe condition.

KMA is delighted to be a part of this exciting affordable housing project with THINK Architecture & Design PLLC and located at 97 Glenmore Avenue in Brooklyn. We are eagerly anticipating the successful completion of this construction project.

Construction is now underway at 97 Glenmore Avenue, the site of a forthcoming affordable housing development in Brownsville, Brooklyn. The building will debut as Glenmore Manor led by private real estate company Brisa Builders Development, non-profit community developer African American Planning Commission Inc., and affordable housing owner-developer Lemle & Wolff Companies.

The consortium of developers is known as Glenmore Managers LLC and received support from community partners Central Brooklyn Economic Development Corporation, We Run Brownsville, Fusion East, and Brooklyn Cooperative Federal Credit Union.

Think! Architecture and Design served as architect of record.

When complete, Glenmore Manor will contain 232 affordable housing units reserved for families earning up to 80 percent area median income. A portion of the units will also be designated for formerly homeless families and low-income seniors.

Total project costs are estimated at $175 million.

Renderings from Think! Architecture depict a two-story glass enclosure at the corner of the property where a new community facility and commercial space known as The B’Ville Hub will take shape. Elsewhere, the façade will comprise colorful teal panels, a punched window system with gold accents, and white cladding above the ninth floor.

The tenth floor is stepped back from the building’s edge to make room for a rooftop garden and a solar array. The project team has not announced what other amenities will be provided to tenants.

The B’Ville Hub will comprise around 20,000 square feet and include spaces for the Central Brooklyn Economic Development Corp, Brooklyn Coop Credit Union, a new asian fusion restaurant, a salon, esthetician training space, and a public radio station.

“Glenmore Manor and the B’Ville HUB offer a unique opportunity for community growth in exponential ways,” said Ericka Keller, managing member of Brisa Builders. “There could only be fantastic benefits to the community in reference to quality housing and economic empowerment through the various opportunities for entrepreneurship that the HUB will offer.”

Glenmore Manor is the latest project to debut as a result of The Brownsville Plan, a city initiative to modify zoning maps and density allowances to spur the development of more than 2,500 affordable housing units, commercial space, community facilities, and enhanced public outdoor space.

“Not only will Glenmore Manor provide high-quality housing to those in need, it will be a hub for entrepreneurship and innovation,” said HPD commissioner Adolfo Carrión Jr. “For over a year, we worked directly with residents to create The Brownsville Plan to create over 2,500 new affordable homes and bring vital public resources to Brownsville. It’s exciting to see that plan put into motion through projects like this one.”

The plan represents a collaboration across several government offices including New York City’s Department of Housing Preservation and Development, the Department of Transportation, and Housing Development Corporation.

Department of Buildings Service Notice - Local Law 109 of 2022: Rodent Abatement During Construction

Effective May 18, 2023, a licensed exterminator is required to treat the premises for rodent extermination, as required by the NYC Department of Health and Mental Hygiene (DOHMH), for the following work:
• Construction work involving 50% or more of the floor area of a building
• Vertical or horizontal enlargement increasing the building floor area by more than 25%
• Demolition of more than 50% of the floor area of a building
• Full demolition of a building.
Beginning June 6, 2023, if the applicant answered Yes to any of the below questions on the Plans/Work (PW1) in DOB NOW, the permit applicant will be required to certify on the PW2 that a licensed exterminator has been retained to effectively treat the premises for rodent extermination as per the requirements of DOHMH.

Full Demolition

All applicants for Full Demolition permits in DOB NOW will be required to certify on the PW2 that a licensed exterminator has been retained to effectively treat the premises for rodent extermination as per the requirements of DOHMH. In addition, applicants for Full Demolition permits in DOB NOW and the Buildings Information System (BIS) are required to submit a Rodent Control Required Item/Document prior to permit issuance.

INTRODUCING THE "TENANT PROTECTION PLAN COMPLIANCE INSPECTION" IN ACCORDANCE WITH THE 2022 BUILDING CODE

As Confirmed by the New York City Department of Buildings, each trade will need to have its own Tenant Protection Plan (TPP) and TPP Inspection, even if subsequent filings are made under the main job document.

To ensure compliance with TPP requirements, the following inspections must be performed at a minimum:
1. Prior to the start of construction and/or demolition, a TPP Compliance inspection will document conditions before work commences.
2. At the start of construction and/or demolition, an inspection is required.
3. Once per week during construction and/or demolition, regular inspections are mandatory.
4. After a TPP violation has been issued, an inspection will verify that the violation has been rectified.
5. If the alteration construction operations have been relocated to another location, an inspection is necessary.
6. Whenever construction operations have changed, requiring updated means or methods of protection, an inspection is needed.
For sign-off, please refer to Code section 1705.26.1 for detailed inspection requirements, unless your project falls into one of the exceptions listed below:
a. Three Family Home
b. Interior of a single occupied dwelling unit with no disruption to essential services of other units. For a dwelling unit within a property owned by a condo or shareholder, the unit must be occupied by the owners of record for that unit.
c. Interior of a single dwelling unit of an occupied multiple dwelling three stories or less in height.

ARE YOU HAVING A CORPORATE SUMMER EVENT?

WE ARE HERE TO ASSIST WITH THE TEMPORARY PLACE OF ASSEMBLY (TPA) PERMIT

Temporary Place of Assembly (TPA) permits are required; by the New York City Department of Buildings (DOB) and Fire Department (FDNY) for gatherings of 75 or more people indoors and large outdoor gatherings of 200 people or more. Specifically, when a space does not have a Place of Assembly Certificate of Occupancy (PACO).

The criteria are:
• 75 or more people in an indoor space
• 200 or more people in a confined outdoor space
• When the expected attendance exceeds the approved occupancy for an existing Public Assembly space.
Tips:
• File TPA requests with the DOB at least 30-45 days before the event date.
• Requests filed with DOB within 10-days of the event will incur additional penalties for each day after the 10-day cutoff timeframe.
• Requests filed with DOB within five days of the event may not be processed timely.
• To file for a TPA, submit a drawing that specifies the layout, fire protection details, exit signs, emergency lighting, ADA accessibility, fireguards, and other relevant information.
Note: All TPAs may be subject to inspection by both the DOB and FDNY at any time. Should the DOB and FDNY choose to visit the event site while the event is underway, a service charge for their inspection (s) may apply.

DOB inspection – No fee

Schedule of FDNY TPA Inspection Fees (fees are based on the number of occupants listed on the DOB’s approved TPA permit):
• Occupancy: 75 to 149 = $415.00
• Occupancy: 150 to 499 = $520.00
• Occupancy: 500 to 999 = $625.00
• Occupancy: 1,000 to 2,499 = $725.00
• Occupancy: 2,500 to 9,999 = $830.00
• Occupancy: 10,000 or greater, and arenas and stadiums (per hour) = $210.00

Additional requirements may apply if the event is on a public street or park. For example, the Department of Transportation and Fire Department flame permits for grills, sternos, ovens, etc.
