Time is Now to Prepare for New Regulations - Information Blocking.
Information Blocking requires your practice to share medical records for Continuity of Care. HIPAA only permitted you to share the records, now there is a legal requirement to share records. Requiring the patient to sign an Authorization for the release may be Information Blocking. In fact, there are only 6 reasons, called exceptions, your practice may not share records and those reasons must be documented in detail. Information Blocking regulations have been interpreted by the Office of the National Coordinator to mean that patients have a right to have all electronic PHI sent to the patient portal as soon as it is available. That means that without completing an exception form, all lab, pathology, radiology and other reports and records must be sent as soon as they come into your EMR.
