A Vacancy / Unoccupancy Provision is a property insurance policy condition or exclusion that can reduce or restrict coverage if a building is vacant (generally empty or without contents) or unoccupied (generally no people’s habitual presence, but contents/furnishings remain) for a specified period of time. Some policies apply these restrictions after a building has been vacant for more than 60 consecutive days, potentially limiting coverage for certain types of losses and even reducing payment for others.

🧠 Example: A fully furnished home sits unused for months while the owner is out of state (unoccupied, but not necessarily vacant). If a loss happens during a period the policy treats as “vacant,” the insurer may argue the vacancy provision applies—changing what is (or isn’t) covered.

⚠️ Why It Matters: These provisions are a common source of claim disputes because “vacant” and “unoccupied” aren’t always the same—and if the provision applies, it can mean certain losses aren’t covered (or payment is reduced) unless you have the right policy language or an endorsement (like a vacancy permit). Know what your policy says before leaving a property empty for an extended time.
