A satisfying victory in the Court of Appeals.

The Michigan Court of Appeals has nixed the ill-advised scheme of Addison Township and Verizon to build a cell phone tower adjacent to the historic property of my client, Kingsbury School. This was a greedy, short-sighted plan which would have plunked a 200-foot tower 90 feet from the old school's eastern boundary on a five acre parcel when their own ordinance requires 20 acres. Their solution: grant themselves a variance.
The Court's decision keeps the kids out of harm's way and leaves un-shadowed the pioneer graveyard which surrounds the old school.

Another victory in the Michigan Court of Appeals, this time in a matter involving the sale of an Andalusian horse. I think that's a half dozen straight in the Court of Appeals. Denied that I wore my muck boots to court.

The firm represents a young woman whose husband was killed at a rail crossing in Tuscola County. I am happy to report that the Michigan Supreme Court recently rejected the application of the railroad to appeal a decision of the Court of Appeals favorable to our client. The case now goes to trial, and the railroad's efforts to delay this matter, pending since 2011, are at an end.

Final Judgment for Oxford landlord referenced in the prior post. The Court gave plaintiff an opportunity to amend her complaint to attempt to state a cause of action based on fraud.
