A question was asked on another page this morning that made me think. The question was is the adjuster's test hard.
I've taken the adjusters test twice over the years. I have also taken and passed the test for public adjusters test and passed.
The class for the adjuster is a two-day class. I did the public adjuster class online and spent a solid week doing it.
The adjuster test was stupid easy. Like you should be embarrassed if you don't pass. The pulbic adjuster test was way more difficult. Actually really got into policy and coverage.
We won't why so many claims are under paid but the training to be an adjuster honestly is bad. The requirements to be an adjuster are almost non-existent.
Shouldn't an adjuster that is actually making coverage decisions have at least the same training as a public adjuster when it comes to policy and coverage?

Something most people don't think about when dealing with an emergency in their home is documentation! Take really good photos of the actual damage and not just the item. What exactly is damaged about the item. Whether it is content or structure photos will tell the story and protect you.
Most content policies say that the policy covers physical damage from a covered peril. If you can't show that it was actually damaged then that item doesn't get paid for.
I know that this is hard but slow down and think about what you are doing and document!

Just settled another claim!
I've had public adjusters tell me for years that certain line items just were unreasonable and just won't fight for them. In many cases I don't think they even asked for the line items.
If you don't ask the answer is always no!
This is why having a public adjuster that actually understands the industry is important.

I've been telling people most of my career not to delay in mitigating the damage to their property. Delay could cause you problems with coverage not to mention additional damages to the property.
I've had adjuster over the years try to deny things due to either delaying mitigation or not mitigating. I was always able to work through this though.
I have a claim now that not only are they not paying for what they consider additional damages but also refusing to pay for the mitigation. Adjuster said that the insured waited too long, and it was no longer required.
Most homeowner have told me when they delayed mitigation that they were scared of doing anything until they talked to the adjuster. The contract that you have with the insurance company (the policy) obligates you to take action. Whether it is covered are not this is your home!
In this case the field inspector inspected that house almost immediately after the loss. He never said you might want to get a mitigation company. The desk adjuster never said you need to mitigate. These adjusters are not looking out for you!
If you have a loss, call a first! It is our job to do a thorough inspection. We help you determine if you need to file a claim, document the claim correctly and get things started (mitigation). Proper documentation is crucial! The insurance company doesn't have to and won't share any of their documentation with you! It is considered work product and they aren't required to.

I hear people say all of the time that they are looking for "reasonably priced" work. Usually repairs or remodeling. This is becoming a pet peeve of mine!
I just left a property that we are consulting on. The owner readily admitted that he was looking for "cost effective". "Reasonably priced or cost effective" isn't always good.
The reason that we are working with this contractor is there was a water damage. In the process of drying the house we are discovering a lot of things. The shower was put together in a way that honestly is making me scratch my head.
1. membrane installed incorrectly
2. fiberboard instead of hardi cement board
3. no seam tape
4. seams not floated
5. no water proofing (red guard)
6. fiberboard instead of mortar bed in shower base
7. shower curb is too short
8. screws for fiber board is at the very bottom of the wall (you are literally penetrating the watertight membrane)

Here's the kicker.... most homeowner policies don't cover poor workmanship. Double kicker... most General Liability policies don't cover bad workmanship.

So, your "reasonably priced or cost effective" work just cost you out of pocket to fix. Was "reasonably priced or cost effective" work really worth the little bit that you saved because actually you didn't save anything!

This homeowner found this guy through a community page. So, he most likely has done this in other houses!

This homeowner actually had another problem that caused the leak which is covered so things will return out alright for them. With the exception of the headache of having to deal with all of this and having to pay a deductible.

Oh, and the contractor's response to all of this was, "not my problem"!

Yet another claim settled! The adjuster wrote the claim exactly as it should have been. He told me upfront that it would have been written differently had I not been there.
Interesting that I have had two adjusters from the same insurance company tell me that now!

We spoke with a newer restoration owner today. He told us about a claim where the insurance company deducted $4K from his mitigation invoice. This is the kind of thing that drives mitigation companies to doing the wrong thing. They become jaded! Like, 'why should we do the right thing if we aren't going to get paid?'
This is why you retain a PA. You want your contractor doing the best job possible and not, ehh work. As a contractor you want to be profitable. From what I have seen on this claim they lost money.

You want a PA that not only is looking to get paid but is looking out for the insured and the contractor!

So, I had an interesting conversation with a carrier adjuster yesterday. He said two thing that I never thought that I would hear from an adjuster.
First, he said that almost no adjuster, Independent, staff or public adjuster really have the knowledge or training that they need to correctly adjust a claim. This is something that we all know but no one is willing to say out loud.
Second, he said that if that claim didn't have a public adjuster it would have been at least partially denied. He said that with a public adjuster on the claim he knew the denial would have been argued and that the carrier would have lost. No point in fighting a losing battle. Also, that there were things he normally wouldn't even consider but again why fight a losing battle.

For those of you that question the need or worth of having a public adjuster I think that this shows the value. The claim is started off much better just by having one retained!

This came up twice last week. I've had this same argument with adjusters for years.
So, I mentioned to the homeowner that since this is a Cat 3 that the house needs to be clean. The mitigation company responded by saying it was sprayed with a biocide. I've had so many adjusters tell me this over the years. "Well, you sprayed it right. Then you don't need to clean." or "we will pay for one but not both." Mitigation companies have adjusted how they address projects from following the standards to what will we get paid for.
First off you don't want to bring a "chemical" into someone's house unnecessarily. So, question is it really needed.
For a Cat 3 it is needed. While just spraying an affected area can be somewhat effective it is not completely effective and it is not the correct way to apply per most manufacturers.
To get the most effectiveness from applying a biocide the effective surface area needs to be thoroughly cleaned. I've heard mitigation guys say, "I'm not a janitor". Well actually you need to be better than most janitors. The cleaner the surface, the more effective the product.
Question your contractor... There is nothing wrong with that. Especially when so many have moved away from the standard of care to, what will I get paid for. I promise you that "I didn't follow the standard of care because I won't get paid for it" won't stand up in court.
If you are going to hire a public adjuster to assist with a claim, then make sure that they understand the "standard of care" as well.

Something to think about...
We had this come up in court not long ago. The attorney for the homeowner questioned why I disregarded so the adjusters report. I explained my exact experience and years in the business. I also explained the tools/meters that we used to determine what was affected. I then asked a question from the stand (which he didn't like). I asked what was the adjuster's qualifications that I should listen to him. What experience did he have? What meters did he use? The attorney actually had to admit that he had no idea!
Something every homeowner should ask of their adjuster. What is your qualifications? Just because you are a licensed adjuster doesn't make you an expert in mitigation or repair. This is why you hire a public adjuster that actually has a background in doing the work.
