Ура! Начиная от 21.11.2022 все украинцы, въехавшие в США по Humanitarian Parole (U4U), могут иметь право на работу без EAD. Плата за I-765 отменена.

Все украинцы прибывшие в США по программе U4U, не должны ждать, пока USCIS одобрит их форму I-765 и могут начать работать первые 90 дней без разрешения на работу. Для этого вам нужно предъявить работодателю вашу форму I-94.

Это распоряжение распространяется на вас, если на вашей форме I-94 в строке
Class of Admission стоит “UHP” (это те, кто заехал по программе U4U), либо “DT” (украинцы, заехавшие по паролю через Мексику)

В течении этих 90 дней, вам необходимо получить Employment Authorization Document и предъявить ее своему работодателю.

На данный момент, бесплатно подать I-765 можно только по почте, прикладывать Fee Waiver не нужно. А с 5 декабря 2022 г. будет доступна и бесплатная онлайн-подача I-765 через сайт USCIS.

USCIS настоятельно рекомендует подавать форму I-765 online.

Why can USCIS send you back your application?

1. You didn't provide answers to all questions of the application. Or mistakes you made are so serious they can't accept it.

2. You submitted an application with the wrong amount of Government fees. Even if you overpay - USCIS will send an application back to you

3. You filed too early. For some immigration benefits, you have to follow a certain timeline. For example, you sent your application before your Priority date becomes current on Visa Bulletin.

Current processing time for Work Authorization - no changes since last month.

At the beginning of this year, USCIS announced that they will de-couple applications for Work Authorization and Advance Parole in order to speed up the process for Work Authorization.

For a moment I don't see any improvements for EAD and on top of that Advance Parole processing time looks even worse.
