The IRS clarified that employers have the controlling decision of whether or not to implement the employee social security tax break. Employers may, but are not required to utilize the relief. Additionally, the IRS confirmed that participation in the payroll tax deferral is optional for non-federal employees. With many states gearing up for distance learning and kids being out of school this fall due to Covid-19, employers with 500 or less employees need to remain compliant with state and federal laws regarding the Families First Coronavirus Response Act (FFCRA). Covered employers are required to provide employees of their rights for Expanded Family Medical Leave and Paid Sick Leave through December 31st, 2020. Up to two weeks of paid sick leave may be available to full and part time employees caring for a child due to on-campus school closures. Employers in violation of the provisions of the FFCRA could be subject to penalties enforced by the U.S. Department of Labor’s Wage and Hour Division. The Continuing Small Business Recovery and Paycheck Protection Program Act was proposed this week in Congress and is intended to correct problems that PPP borrowers have had, while opening up new opportunities for borrowers. There are a few new requirements for borrowers who want to know if they can borrow more, more flexible covered periods in which a borrower has to spend sufficient amounts to receive funds, and an expanded list of forgivable expenses. One key element to this is that borrowers with loans under $150K would not be required to submit the previously issued application and would result in a much more streamlined loan forgiveness process. This has not yet been signed into law, but it is highly likely that this new act will be passed with bi-partisan support. There will likely be an additional round of PPP loans available for businesses in the near future. Secretary Munchin suggested that Congress would reauthorize the program to allow for a second PPP check to go out to the businesses hardest hit by the pandemic. The Secretary discussed a revenue test to ensure that businesses that receive future loans must actually need them. Congress has three weeks before recess to come to an agreement on a new PPP plan to help small businesses, coupled with a new economic stimulus package that would assist individuals during these challenging times. With unanimous consent, the Senate passed legislation that would keep the Paycheck Protection Program (PPP) alive and give the Small Business Association authority to continue approving PPP loans through August 8th, 2020. The bill has been sent to the House where it is expected to be passed and then sent to the President’s desk to be signed into law. The new deadline is August 8th, chosen because it marks the end of the Senate’s next work period and legislators hope they can pass the next economic relief package within that time.
