🏛️ Proyecto de Ley Federal de Transparencia y Protección al Consumidor de Tiempos Compartidos:

La Ley de Transparencia de Tiempos Compartidos (a veces también llamada Ley de
Transparencia de Precios de Tiempos Compartidos o Ley de Protección de Tiempos Compartidos) fue presentada en el Senado de los Estados Unidos el 16 de diciembre de 2025 por los senadores John Curtis (R-UT) y Adam Schiff (D-CA).

Este proyecto de ley bipartidista tiene como objetivo:
• Exigir divulgaciones más claras de todos los costos, tarifas y términos del contrato.
• Otorgar a los compradores un período definido de cancelación (por ejemplo, 14 días) para reconsiderar sin penalización.
• Mejorar la transparencia y reducir las prácticas de venta depredadoras ampliamente denunciadas en la industria de los tiempos compartidos.

Aún no ha sido aprobado por ambas cámaras del Congreso ni ha sido firmado como ley. Por lo tanto, se trata de legislación propuesta y todavía no es una ley que pueda invocarse.

🏛️ Federal Timeshare Transparency/Consumer Protection Bill:

The Timeshare Transparency Act (sometimes also referred to as the Timeshare Pricing Transparency Act or Timeshare Protection Act) was introduced in the U.S. Senate on December 16, 2025 by Senators John Curtis (R-UT) and Adam Schiff (D-CA).

This bipartisan bill aims to:
• Require clearer disclosures of all costs, fees, and contract terms.
• Give buyers a defined cancellation window (e.g., 14 days) to reconsider without penalty.
• Improve transparency and reduce predatory sales practices widely reported in the timeshare industry.

It has not yet passed both chambers of Congress or been signed into law. So it’s proposed legislation, is not a law you can invoke yet.

🧾 What This Means for You Now:

If you believe you were subject to fraud, elder abuse, or unfair sales practices, you may have options under existing laws — such as:
• State rescission/cancellation rights where you bought the timeshare.
• Federal consumer protection laws (FTC Act, “cooling-off” rule).
• Remedies through state attorneys general or civil lawsuits.

Because the proposed Timeshare Transparency Act isn’t law yet, you can’t cite it by itself to cancel a contract at this moment.

Timeshare lawsuits against Wyndham often allege deceptive sales tactics, such as misrepresenting property value, making false promises about resale, concealing high costs (like fees and interest that can exceed standard lodging), and using high-pressure, lengthy sales presentations to induce purchases and upgrades, leading to claims of fraud, contract violations, and elder financial abuse, with some cases challenging arbitration clauses or issues with the Service Members Civil Relief Act.

Common Allegations in Owner Lawsuits:

Deceptive Sales Practices: Sales agents allegedly lie about features, benefits, resale potential, and costs, making timeshares seem like valuable assets when they are illiquid.

Misleading Costs: Lawsuits claim owners aren't told that combined fees and interest can make nightly rates extremely high, far exceeding what non-owners pay for similar bookings.

Difficulty Reselling: Owners are promised easy resale, but the properties have little to no aftermarket value, making them nearly impossible to sell.

Contract Issues: Claims include unenforceability of arbitration clauses, adding costs through upgrade promises, and making children liable for multi-generational debt.

High-Pressure Tactics: Long sales meetings (4-9 hours) and false urgency are used to pressure owners into signing contracts.

Service Members Civil Relief Act Violations: Some suits allege violations of laws protecting service members.
