I was in Yolo county representing client on criminal case. There were not many cases that were out of custody and my clients case was one of them. Often cases are filed and not DA assigned until second appearance. One can get false sense of security since no one has looked at the case. Sometimes the case can be dismissed right away but not if no one is looking at it. Most of the time, the District attorney will not dismiss unless the attempt to contact the victim..I am not talking about crimes with out a victim.

A deposition can set the tone for the case. So many attorneys ask a lot of detailed questions and the more a client volunteers information, the more they dig deeper. The hole can be too big to crawl out of. In prep for the depo, an attorney can see how open the client will be .Sometimes they client will hold back when I am asking them but then when defense attorney asks, they start opening up. Not that it is good idea to with hold information. Some times the attorney has all kinds of information and some times they do not . What is not proper is to keep asking the same thing... One attorney even would repeat back his questions and the answer and say is that correct? Sometime clients answer question with a lowering tone as if they are unsure of the answer as if they are stating their answer as a question and they are unsure. The one rule is to not make statements . One can correct to say that I had the wrong year of employment it was a year earlier but not to say, hey my memory is bad, so I am really unsure of the year.

I see that one attorney advise one to be nice in a deposition. This does not always work. Some times the defense attorney has information from employer that is wrong. Like one employer claim employee was playing music on her phone and was cursing out clients.. Often the defense attorney will ask if these things are true without naming their source or what exactly is alleged I do agree that not being angry is important and to show composure..

If you have several workers compensation cases that are open and active, it is best to resolve one before they all get intertwined and they will drag out for ever. Had deposition last week and there was many cases and issues of causation.

Patience in important in law. The system does take more time than it should . That is why it is important that the paper works needs to take the into account . It is important to file new pleading when matters change. It is also important to get into court and if the court is crowded, one still needs to start the process. Each county handles things differently and this can seem unusual to non attorneys.

In a mutual fight between two men of someone chokes out the other is it attempted murder ?
I found my wife in my house in bed with another man . I fought him and did hit him first . He also hit me in the head a couple times and his life was not in danger . He had the advantage as I was on the ground being punched in the temple region of the brain . I saw stars then was choked from the back and said I couldn’t breathe . He continued to choke me until I almost blacked out . My last effort I got my hand under his arm and elbowed him in the groin and face to break free . I almost blacked out as I stood up . The fight stopped as I could not continue . He left my house .
