THE CLEARINGHOUSE

What is it?

The CDL Drug and Alcohol Clearinghouse will be operational on January 6, 2020. The clearinghouse will be a database of positive drug and alcohol test results for Commercial Driver License (CDL) holders that employers will be required to check prior to putting a new employee to work. Employers will also be required to annually query the Clearinghouse for each driver they currently employ or utilize. (Note:) It is NTA’s recommendation that you do this in January of each year because it is easier to remember.

Designed to improve highway and public safety, the Clearinghouse will allow employers and FMCSA to identify drivers with a prohibited DOT drug and alcohol program violation and ensure said drivers take the required steps to return to work.

Additionally, employers will be able to query the database to identify drivers who may have committed a drug or alcohol program violation while working for one employer, but who fail to subsequently inform another employer.

Effective January 6, 2020, FMCSA will require that the Commercial Driver License number and state of issuance be used when reporting positive drug and alcohol test results to the clearinghouse.

CDL Clearinghouse Required Actions

Therefore, as of January 6, 2020, when completing the Federal CCF or the Alcohol Test Form for a CDL holder covered by FMCSA:

Collectors and BATs will no longer use the employee’s social security number or other identification number when completing the forms, but will instead use the employee’s CDL number and state of issuance.
Employers are to provide the collector and/or BAT with the employee’s CDL number and state of issuance.
If the employer does not provide the employee’s CDL number and state of issuance, the collector and/or BAT should ask the driver for this information.
If the CDL number and state of issuance is not included on the form, the collector will still send the specimen to the lab for testing.
If the laboratory receives a specimen without the CDL number and state of issuance, the lab will process the specimen without delay and send confirmed positive results to the MRO.
If the MRO receives a confirmed drug test result without the CDL number and state of issuance, the MRO should contact the employee or the employer to get that information.
The MRO is responsible for reporting positive drug test results to the clearinghouse database, and the CDL number and state of issuance is necessary in order to report the results.
The BAT reports positive alcohol test results to the employer, who is then responsible for reporting positive alcohol test results to the clearinghouse.

THE USE OF MA*****NA FOR RECREATIONAL PURPOSES AND THE DOT REGULATIONS. PLEASE READ:

DOT OFFICE OF DRUG AND ALCOHOL POLICY AND COMPLIANCE NOTICE
Recently, some states passed initiatives to permit use of ma*****na for so-called “recreational”
purposes.
We have had several inquiries about whether these state initiatives will have an impact upon the
Department of Transportation’s longstanding regulation about the use of ma*****na by safetysensitive
transportation employees – pilots, school bus drivers, truck drivers, train engineers,
subway operators, aircraft maintenance personnel, transit fire-armed security personnel, ship
captains, and pipeline emergency response personnel, among others.
We want to make it perfectly clear that the state initiatives will have no bearing on the Department
of Transportation’s regulated drug testing program. The Department of Transportation’s Drug and
Alcohol Testing Regulation – 49 CFR Part 40 – does not authorize the use of Schedule I drugs,
including ma*****na, for any reason.
Therefore, Medical Review Officers (MROs) will not verify a drug test as negative based upon
learning that the employee used “recreational ma*****na” when states have passed “recreational
ma*****na” initiatives.
We also firmly reiterate that an MRO will not verify a drug test negative based upon information
that a physician recommended that the employee use “medical ma*****na” when states have
passed “medical ma*****na” initiatives.
It is important to note that ma*****na remains a drug listed in Schedule I of the Controlled
Substances Act. It remains unacceptable for any safety-sensitive employee subject to drug testing
under the Department of Transportation’s drug testing regulations to use ma*****na.
We want to assure the traveling public that our transportation system is the safest it can possibly
be.

More than likely the letter you received was sent from a private company that is aggressively marketing supervisor training to motor carriers. Neither FMCSA nor any other agency within the U.S. DOT is affiliated with or endorses the services offered by these companies. FMCSA is monitoring the marketing of training services by private entities, and is taking steps to ensure that these companies are not representing themselves as affiliated with or endorsed by FMCSA.

All persons designated to supervise drivers of commercial motor vehicles that require a commercial drivers license can find information and resources here on who is required to take Drug and Alcohol Supervisor Training.

Los empleadores deben proporcionar entrenamiento a todas las personas que supervisan conductores. El propósito de esta capacitación es permitir a supervisores determinar si existe alguna sospecha razonable y exigir a un conductor a someterse a las pruebas descritas en §382.307.
