As professional security guards, duties go far beyond patrolling. They are rooted in law and compliance. Understanding the specific codes that define our authority is essential to performing our job lawfully and effectively.
For armed guards, two California Penal Code (PC) sections are critical to remember:
• PC 12031 (D)(5): This section, along with PC 25850, provides an exemption that allows uniformed security guards to lawfully carry a loaded firearm in public. This exemption applies when they are regularly employed and compensated and are actually engaged in protecting and preserving the property of their employers, or on duty or en route to or from their duty location.
• PC 26030 (A)(10): This is the current statute that provides a similar exemption for uniformed and regularly compensated security guards (and uniformed alarm agents) from the general prohibition against carrying a concealed or loaded firearm. This exemption applies while the guard is protecting the employer’s property, or on duty, or going to/from work.
