If your business is shutting down over Christmas and New Year, these are the rules about asking staff to take annual leave:

• employees can be directed to take leave if there are rules in their award or enterprise agreement that allow it and the direction is reasonable

• if there are no rules, a permanent employee needs to agree to take annual leave

• employees who aren’t covered by an award or agreement can be directed to take annual leave if the direction is reasonable.
