[提案: 修改入職表格I-9. Verifying Employment Eligibility: Changes to Form I-9 Proposed] ..續上篇po文:

那麼, 到底修改了哪些內容呢? 請看以下:
The USCIS stated that the proposed form:
* Checks certain fields to ensure information is entered correctly;
* Provides additional spaces to enter multiple preparers and translators;
* Includes drop-down lists and calendars;
* Provides instructions on the screen that users can access to complete each field;
* Includes buttons that will allow users to access the instructions electronically, print the form and clear the form to start over;
* Provides a dedicated area to enter additional information that employers are currently required to notate in the margins of the form; and
* Will generate a quick-response matrix barcode, or QR code, once the form is printed. The QR code can be used to streamline audit processes.

Other proposed changes to Form I-9 include:

* Requiring employees to provide only other last names used in Section 1, rather than all other names used;
* Streamlining the certification in Section 1 for certain foreign nationals; and
* Separating the instructions from the form to bring the form in line with USCIS’ practices.

[提案: 修改入職表格I-9. Verifying Employment Eligibility: Changes to Form I-9 Proposed]

昨日, 美國移民局(USCIS)在聯邦註冊處(Federal Register)登出告示, 提案修改"就職資格驗證"表格I-9.
(Yesterday, U.S. Citizenship and Immigration Services (USCIS) published a notice in the Federal Register regarding proposed changes to the Form I-9, Employment Eligibility Verification.)

根據移民局的說法, 此次修改I-9表格主要是要減低技術上出現的錯誤, 和幫助用戶在USCIS.gov網址下載表格后更好的完成表格.
(According to USCIS, many of the proposed changes to the Form I-9 are intended to help reduce technical errors and help customers complete the form on their computer after downloading it from uscis.gov.)

此提案開放給公眾發表意見的咨詢期為60天, 截止至1月25日2016年. The public comment period on the proposed changes is open for 60 days, until January 25, 2016.

經過60天的公眾咨詢期后, 移民局USCIS會根據收集到的公眾意見另外給出第二個30天的咨詢期. 移民局會在I-9 Central裡面公佈有關咨詢期事項.
(After the 60-day comment period ends, USCIS may make changes to the form based on comments received and will publish a second notice in the Federal Register. The public will then have an additional 30 days to provide comments on proposed changes. USCIS will notify the public about these comment periods on I-9 Central.)

Thanksgiving is just around the corner! This can be a good time to reflect on ways that a company can recognize and thank employees for their work efforts.

Recognition doesn’t just mean extra compensation or tangible benefits – although those things are always welcome! It can be as simple as acknowledging, in a timely manner, a job well-done or extra effort given.

And while the majority of organizations still close their doors on Thanksgiving, some such as those in the safety, hospitality and retail industries will keep their doors open.

California law does not require that an employer provide its employees with paid holidays, that it close its business on any holiday, or that employees be given the day off for any particular holiday. It’s really up to your company policy (and other considerations, such as religious accommodation requests). However, some companies do choose to provide special premium holiday pay when employees are required to work. If that is your practice, make sure to follow it consistently and outline it in advance.

Companies that are open for business on Thanksgiving may also give other incentives, such as free food to employees throughout the day, gift certificates to local restaurants, or additional employee discounts.

[新法案?? 提案免除員工犯罪背景審查?? Ban the box, Criminal History.]

近日, LA市和LA縣分別作出提案, 如果通過的話將會影響到LA一片地區的商業哦!! (The City of Los Angeles and the County of Los Angeles took separate actions that, if passed, could affect businesses in those areas.)

LA時報報道, LA市議會正在考慮一項提議--"Ban the Box", 既在公司開出有條件限制的就業錄取通知書之前, 請人單位禁止在入職申請表格中列出員工有否犯罪背景的問題, 也不能對申請入職者進行犯罪背景調查. 據新聞報導, 市議會委員會已要求市律師辦公室起草一項新的法令將適用於10個(或以上)員工的公司. 該提案將送往市議會進行審批. (The Los Angeles Times reported that the City Council is considering a proposed “ban the box” ordinance which would prohibit covered employers from asking about criminal convictions on an application form or running a criminal background check until a conditional offer of employment has been made. According to the news report, a City Council committee has asked the city attorney’s office to draft a new ordinance that would apply to employers with 10 or more workers. The proposal would head to the City Council for approval.)

California’s Upcoming Minimum Wage Increase
On January 1, 2016, California’s minimum wage will increase to $10 per hour from the existing minimum wage of $9 per hour.

僱主們需要開始做工資提升的準備工作啦! 同時, 僱主們要切記, 州政府的執法機關尤其注重員工的薪資有無被"盜竊", 也就是僱主們有無付最低時新給員工的全部工作時間.
Employers need to prepare for the minimum wage increase. Also, employers should remember that state enforcement agencies have made it a top priority to stop employers from engaging in so-called “wage theft,” which includes not paying the minimum wage for all hours worked.

[夏令時結束, 本週末調時鐘囖!!!..] Get Ready to "Fall Back".!!! 對, 今年的Fall Back時間正是萬聖節之後的凌晨2:00am(11/1/2015, 2:00am變1:00am)!! 大家就可以盡情地在萬聖節當晚玩久一點啦, 因為會有1個小時的extra time去睡覺呢!!~

大家有沒有想過這一年2次的調時鐘會對大家的工作有什麼影響呢? 對於白天工作的人可能并沒有太大的影響(頂多就是可能會遲到/早到), 但是對於要在夜晚工作的人和公司就產生一些問題. 因為夏令時的開始與結束時間都在凌晨2:00am, 所以在這個時間段有夜間工作的員工都會減少一個小時工作時間(夏令時開始), 或者多出一個小時工作時間(夏令時結束).

像這樣有夜班工作員工的公司, 要怎麼計算員工的薪水呢? 這個時候僱主應當付員工實際工作時間, 而不是看鐘錶上面的時間(除非是用電腦上的時鐘, 或是有自動調節夏令時功能的時鐘)

舉個例子:
如果一個夜班工人的工作時間是11:00pm到次日7:30am(中間包含30分鐘吃飯/休息時間)總共工作8小時. 如果公司規定員工做滿8小時, 那麼在夏令時開始的當晚, 該夜班工人就要工作至8:30am; 相對的如果在夏令時結束的當晚, 該夜班工人就要工作至6:30am. 這樣有明白嘛?

沿用上面例子, 如果公司是規定工作時間一定要是11:00pm-7:30am的話就會產生超時工作的問題(Overtime)囖!. 像是在夏令時結束的當晚, 如果要工作至7:30am, 工人就要工作9個小時啦! 所謂"超時工作"就是在"一個工作天"里做工時間超過8小時, 當然, 要計算是不是超時還要看公司怎麼定義"一個工作天". 所以, 如果工作了9小時, 僱主必須付9小時的薪水. 有沒有"超時工作(Overtime)"就要看貴公司的Policy/Handbook囖!!

**(所以說, 公司Policy和員工手冊Employee Handbook都是必不可少的{寶典}, 釐清不少未來的紛爭和疑問呢!! 呵呵~)

For 2016, the Social Security Administration announced that the Social Security taxable wage base will remain the same — $118,500 maximum taxable earnings. [社安局宣佈2016年薪資最高繳稅額維持不變在$118,500]

The Social Security withholding rate is unchanged for 2016 and remains at 6.2 percent, up to the maximum taxable amount. The F**A tax rate – which is the combined total of the Social Security tax rate and the 1.45 percent Medicare tax rate — also remains unchanged at 7.65 percent. [2016年社安扣繳率維持在6.2%, 最高扣繳額為$118,500. F**A稅率(包含社安稅和1.45%醫療稅率)也保持不變在7.65%]

Individuals with earned income of more than $200,000 ($250,000 for married couples filing jointly) pay an additional 0.9 percent in Medicare taxes. [個人所得收入超過$200,000(夫婦二人一起報稅超過$250,000)則需額外繳納0.9%醫療稅]

There is no limit on the amount of wages subject to the Medicare tax. [醫療稅收對工資沒有限制]
