To all the Towing companies in highlands county!
Stop just pulling up on a ACCIDENT SCENE and SOLICITING! I have seen multiple companies do it. No excuses new companies or old. If you’re not called out there by the CUSTOMER or ROTATION, STAY AWAY! There are consequences and this is your warning! Punishable up to a misdemeanor, $500 fine, and the vehicle used could be impounded. Florida law prohibits unsolicited towing solicitation, making it illegal for an unauthorized tow truck operator to solicit services at an accident scene or to tow a vehicle before an authorized tow truck arrives. However, a vehicle owner can initiate contact with an unauthorized tow operator after speaking with law enforcement. Rules against unsolicited solicitation Unauthorized operators: It is illegal for an unauthorized wrecker operator to drive by an accident scene and solicit towing services.
Authorized vs. unauthorized: If law enforcement has not called for a specific tow service, an authorized tow operator from a wrecker system has priority. An unauthorized operator cannot solicit business from an accident scene where an authorized operator has already been called.
Penalty: Violating this rule is a misdemeanor of the second degree, and the vehicle used in the offense can be impounded.
