Misconception #2: States Have the Power to Make Their Own Laws

The legislative power of the United States is vested in Congress, not in the states. The states were never meant to be autonomous lawmakers. It’s true that states pass statutes—but these statutes were originally intended to be ordinances, merely to put things in order, and were not meant to carry the weight or the force of law.

State legislatures are often structured and modeled after Congress in appearance—but their function is fundamentally different. State legislatures were designed to be assemblies for deliberation. Their role is to:

* Serve as forums for public discussion, where issues could be debated and interests considered.

* It's composition consists of elected officials that represent the interests and thoughts of the local population,

* For the purpose of developing a consensus among the collective. To form a position on public issues.,

* A unified position of the state that would then be represented in the U.S. Congress through their federal delegation.

They were never intended to pass laws with independent authority from the federal system. Rather, they were intended to organize and channel the people’s will into the national legislative process.

Under this model, representatives represent people, not parties or factions. And the people themselves are active participants in the political process—engaged, informed, and involved.

A state is not a seperate, independent entity. The state is a structured part of the whole, an interdependent member of a collective body.

Misconception: The Federal Government Has Complete Control Over Immigration

The Constitution grants Congress the exclusive power to determine the rules for citizenship in the United States:

“To establish a uniform Rule of Naturalization…” — Article I, Section 8, Clause 4

But not all residents are citizens. Citizenship is a specific legal status. People may live in the U.S. as:

* Permanent residents (green card holders),
* Foreign nationals,
* U.S. national
* Asylum seekers,
* Temporary workers,
* Or members of a tribe.

Tribal nations, for example, have a government-to-government relationship with the U.S. They define their own membership criteria, which is entirely separate from U.S. citizenship.

Similarly, states retain certain powers when it comes to immigration; and the people retain powers when it comes to migration—meaning the lawful movement and residence of individuals within a region. While states cannot confer national citizenship, they do have by the reservation of power to:

* Permit residency
* Grant access to public services,
* Allow for voting in state or local elections,
* Issue temporary work permits under state-managed programs.

In short, while Congress controls naturalization, states have a legitimate role in shaping their internal social fabric through residency and access policies.

Most of of us were told when you want to build credit, start out with a store credit card. That was BAD ADVICE. So here's some BETTER advice.

Apply for a secured credit card with a $0 annual fee. You'll pay a deposit of whatever amount you want the limit to be. $200 is a good starting point. Use that card to pay your standing monthly bills, i.e. phone bill, utility bill, subscriptions, ect. Don't use it for anything else. Buy only what you can afford on credit, things you'd pay for anyway, with or without the card. Now when you get your paycheck instead of paying the bills, (you already paid with credit) use that money to pay off the card. You won't be charged interest if you don't carry a balance. Pay it off every month.

Do that for 3 -6 months. Then you'll start to get credit offers. Don't sign up for any card that has an annual fee. The first offers are bait. Wait for better offers...higher limits, low interest rates, no interest for 24 months, ect.

By the authority vested in me as President by the Constitution and the laws of the United States of America, and to enable parents, teachers, and communities to best ensure student success, it is hereby ordered:

Section 1. Purpose and Policy. Our Nation’s bright future relies on empowered families, engaged communities, and excellent educational opportunities for every child. Unfortunately, the experiment of controlling American education through Federal programs and dollars — and the unaccountable bureaucracy those programs and dollars support — has plainly failed our children, our teachers, and our families.

Taxpayers spent around $200 billion at the Federal level on schools during the COVID-19 pandemic, on top of the more than $60 billion they spend annually on Federal school funding. This money is largely distributed by one of the newest Cabinet agencies, the Department of Education, which has existed for less than one fifth of our Nation’s history. The Congress created the Department of Education in 1979 at the urging of President Jimmy Carter, who received a first-ever Presidential endorsement from the country’s largest teachers’ union shortly after pledging to the union his support for a separate Department of Education. Since then, the Department of Education has entrenched the education bureaucracy and sought to convince America that Federal control over education is beneficial. While the Department of Education does not educate anyone, it maintains a public relations office that includes over 80 staffers at a cost of more than $10 million per year.

Closing the Department of Education would provide children and their families the opportunity to escape a system that is failing them. Today, American reading and math scores are near historical lows. This year’s National Assessment of Educational Progress showed that 70 percent of 8th graders were below proficient in reading, and 72 percent were below proficient in math. The Federal education bureaucracy is not working.

Closure of the Department of Education would drastically improve program implementation in higher education. The Department of Education currently manages a student loan debt portfolio of more than $1.6 trillion. This means the Federal student aid program is roughly the size of one of the Nation’s largest banks, Wells Fargo. But although Wells Fargo has more than 200,000 employees, the Department of Education has fewer than 1,500 in its Office of Federal Student Aid. The Department of Education is not a bank, and it must return bank functions to an entity equipped to serve America’s students.

Ultimately, the Department of Education’s main functions can, and should, be returned to the States.

Sec. 2. Closing the Department of Education and Returning Authority to the States. (a) The Secretary of Education shall, to the maximum extent appropriate and permitted by law, take all necessary steps to facilitate the closure of the Department of Education and return authority over education to the States and local communities while ensuring the effective and uninterrupted delivery of services, programs, and benefits on which Americans rely.

(b) Consistent with the Department of Education’s authorities, the Secretary of Education shall ensure that the allocation of any Federal Department of Education funds is subject to rigorous compliance with Federal law and Administration policy, including the requirement that any program or activity receiving Federal assistance terminate illegal discrimination obscured under the label “diversity, equity, and inclusion” or similar terms and programs promoting gender ideology.

Sec. 3. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:

(i) the authority granted by law to an executive department or agency, or the head thereof; or

(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Rental property: asset or liability? On one hand there’s security in a passive source of income. On the other hand, it can be a constant source of stress and added expense. Whatever the case maybe, you do have options. Sometimes you just need a new strategy, a plan B.

Throw out the templates and revamp the lease agreement. Make an offer, that after 3 months of on time payments they have the option to buy. There’s a goal and also incentive. Next, refer them to a credit counselor or a credit repair agency so that during those first 3 mos. they can work on getting qualified. Offer to return their security deposit to be used toward the down payment. With an FHA loan they won’t need to put very much down. It's an attractive offer that doesn’t cost you anything. Once approved, they have a permanent residence, a mortgage loan, and a new relationship with the bank. You have a check for one lump sum and you are freed of all responsibility.

You can buy more property and do it all over again …..Or you can take the money and run! 😂
