I-9 Form Updates

To stay compliant with the new Federal immigration laws, employers should begin to use the new streamlined I-9 Form starting August 1st, 2023.


What's New?


✅ The new I-9 will be available on August 1, 2023.

✅ Employers must begin using the new I-9 form no later than November 1, 2023. If the old version of the I-9 is used after that date, the employer can be penalized.

✅ The new I-9 is only one page long to make it easier for both employees and employers. Other improvements include clearer instructions and providing guidance on acceptable documents and the auto-extension of certain documents.


Although the groundwork has been laid for permanent remote examinations to become a reality for all businesses based on the new regulation, the Department of Homeland Security (“DHS”) confirmed that only E-Verify using businesses who are in good standing may continue to conduct verifications electronically beyond August 1, 2023.

E-Verify employers performing remote verification must conduct a live video interview with the employee, retain copies of all documents presented in the I-9 verification process and create E-Verify cases for new employees.

All other businesses must change back to physical, in-person, inspections of documents to verify identity (either by the employer or an Authorized Representative using the DHS-authorized alternative procedures).


For our Vested clients, our HR system will be updated with the new I-9 form when released. Additionally, we will send the revised form to clients who prefer to use paper onboarding documents."

"New Florida Immigration Bill Signed into Law

Starting July 1, employers with 25 or more workers must use E-Verify for new hires. The new law, SB 1718, will increase penalties for noncompliance and hiring undocumented workers.

Key Takeaways from SB 1718

✅ E-Verify: Requires private employers with 25 or more employees to use E-Verify, in addition to completing Form I-9, to check the employment eligibility of employees.

✅ Potential Impact on Your Business Licenses for Employing Unauthorized Aliens: An employer who knowingly employs illegal aliens can have their business licenses suspended or revoked.

✅ Penalties for “Human Smuggling”: The penalties increase in severity from 5 years in prison and a $5,000 fine per offense (third-degree felony) to a second-degree felony subject to a $10,000 fine and up to fifteen (15) years in prison.

✅ Expands the Florida Department of Law Enforcement (FDLE) Mission: The FDLE mission of counter-terrorism efforts has been expanded to include coordinating with, and providing assistance, to the Federal Government in the enforcement of federal immigration laws within or affecting Florida.

✅ More Funding for Relocation: Provides $12 million to continue the Unauthorized Alien Transport Program to relocate illegal immigrants to sanctuary jurisdictions.

✅ Bans on ID Issuance: Bans local governments and NGOs from issuing identification documents to illegal aliens. It also invalidates all out-of-state driver's licenses and permits issued exclusively to illegal aliens.

✅Impact to Hospitals: Requires hospitals that accept Medicaid to collect citizen status of patients and report healthcare costs for illegal aliens.
