The Truth About Medicare Advantage & Facility Misinformation
Every AEP, good Medicare agents watch the same heartbreaking pattern: nursing homes, rehab centers, physical therapists, and even doctors, nurses, or office staff telling seniors to cancel their Medicare Advantage plans. You may have seen the nonstop social media posts.
These posts incense me. Please forgive the long post, but if you or someone you love is on Medicare, it is important to read it.
It’s frustrating, it’s dangerous, and it’s almost always based on misinformation — not Medicare rules.
These individuals care about their patients, but they are not licensed insurance agents, they are not trained in Medicare, and they have no authority to tell anyone to change coverage.
Here are the facts.
❌ Myth #1: “Your Medicare Advantage plan is denying your care — switch back to Medicare.”
✔ Truth: Most denials happen because the facility failed to meet Medicare’s medical‑necessity rules — not because of the insurance plan.
CMS/OIG audit data confirms this:
The 2022 OIG audit found 61% of denied SNF claims were due to insufficient documentation — not the insurance plan.
The same audit found 87% of MA denials were legitimate under Medicare rules.
Common documentation failures include:
Missing or vague progress notes
No measurable evidence of skilled‑care need
Therapy notes not supporting continued treatment
Lack of physician orders
When documentation is missing, Medicare legally cannot pay the claim — MA or Original Medicare.
This is a documentation problem, not a “bad plan” problem.
❌ Myth #2: “If you drop your MA plan, your rehab will be approved.”
✔ Truth: Cancelling your plan does not fix documentation failures.
If the facility cannot prove medical necessity:
Original Medicare will likely deny the claim too.
The patient may owe 100% of the cost. Yes, 100%.
The facility may discharge the patient early.
Cancelling a plan does not magically create medical necessity.
❌ Myth #3: “Your plan doesn’t pay us enough — switch to Medicare.”
✔ Truth: This is a billing complaint, not medical advice — and yes, the title is defendable.
Here’s why:
Original Medicare often reimburses higher fee‑for‑service rates for certain SNF and rehab services than Medicare Advantage.
Some facilities prefer Original Medicare because it requires less documentation and pays more predictably.
Medicare Advantage requires proof of medical necessity, progress, and clinical justification — which some facilities struggle to provide.
But none of this means switching is in the patient’s best interest.
And again:
These staff members are not licensed agents. They have no training in Medicare enrollment rules and no responsibility for your long‑term financial protection.
❌ Myth #4: “You’ll lose access to your specialists if you stay on Medicare Advantage.”
✔ Truth: If a patient cancels their MA plan, Original Medicare takes over — and any specialist who accepts Medicare assignment can still treat them.
The real danger is this:
If the patient is sick enough to be in a facility, they may not pass underwriting for a Medicare Supplement unless they qualify for guaranteed‑issue rights at that exact moment.
If they don’t qualify:
They may be stuck on Original Medicare
With no out‑of‑pocket maximum
And 20% coinsurance on every Part B service
No ability to ever get a Medigap plan again if their health prevents passing underwriting.
This can create lifelong financial exposure — not just for the year.
And if they lose Part D drug coverage by accident, they may face:
Permanent late‑enrollment penalties
Higher drug costs for life
Limited access to medications
Again, cancelling a plan in a facility can create financial harm that lasts the rest of their life. Not just that moment in time.
❌ Myth #5: “We can help you switch your plan.”
✔ Truth: Facilities are not allowed to recommend plans or enroll patients.
CMS rules prohibit:
Recommending specific plans
Telling patients to cancel coverage
Pressuring families
Filling out enrollment forms
Rare exception:
Some facilities bring in outside agents or brokers — but you must ask yourself:
Are they working for YOU, or for the facility?
Always make sure:
The agent represents multiple carriers
The agent explains all options, including staying on your current plan
The agent explains the risks of dropping your plan while in a facility
The agent reviews drug coverage, networks, and costs before making any change
If they can’t do that, they’re not working in your best interest.
❌ Myth #6: “A denial means you’re stuck.”
✔ Truth: Medicare Advantage denials can be appealed — and appeals succeed often.
Federal oversight data shows:
75% of MA appeals result in the denial being overturned when beneficiaries or representatives actually file the appeal.
Most people never appeal — which is why facilities assume denials are final.
Appeals work.
Documentation matters.
Cancelling your plan does not.
🌱 The Bottom Line
If you or a loved one is in a nursing home, rehab, or hospital and someone says:
“Cancel your Medicare Advantage plan.”
“Switch back to Medicare.”
“Your plan is the problem.”
“We can help you change your coverage.”
Stop. Do not sign anything.
These individuals:
Are not licensed insurance agents
Are not trained in Medicare rules
Are not responsible for your long‑term financial protection
Most denials come from documentation failures, not your insurance plan.
And cancelling coverage during a facility stay can create serious financial harm — sometimes for the rest of your life.
